Ok.. There are two things that have me fired up this morning. 1. Since Governor Justice issued the stay at home order, I have received numerous phone calls from co-signers stating they want to remove their name from the bond and put the defendant back in jail. STOP!! IT IS A MYTH! Once you sign the Indemnity Agreement, it is legally binding. You do not have the authority to relieve yourself from the contract. All of which is explained to you THOUROUGHLY before you sign it. We only enforce the criminal bail agreement and the terms and conditions for release on bail. We are not a referee because you cannot get along. We do not revoke because you spilt up. We do not revoke for non-payment (You get sent to collections per the opinion of Judge Sanders). Unless you have some concrete evidence that the defendant is a flight risk or has violated one of the eight conditions, don't waste either of our time! We answer to a Judge and we better have a damn good reason for revoking someone's constitutional rights and incarcerating them.
2. The state code states we have to charge a minimum of 10% with a minimum of 3% down and the balance has to be paid within 12 months. If we don't, we could be fined, imprisoned, and lose our license. If you have a bondsman that is violating this rule, that should speak volumes about their character....

Berkeley County courts adjust to new COVID-19 protocols
Until this virus situation is under control, we have passed the following policy for both our safety:
1. There cannot be more than two customers in the office at one time.
2. You must wash your hands before enterimg the building. We have set up a handwashing station on the porch for your convenience.
3. If you are sick, please call us and we will come out to your vehicle.

FYI for anyone that planning a visit at any WV Regional Jail... "Due to the recent health concerns with the Coronavirus, Regular Visits have been suspended. Attorney Visits and Electronic Visits may still occur."

Tomorrow, HB 2419 will be presented to the Senate Judiciary Committee. I am asking for everyone's help. Below is a list of the committee and they are the ones who decide whether the bill advances or not. Please call them today and tell them you are opposed to the bill. Google bail reform in New York, New Jersey, and California.. West Virginia does not need to follow. They have showed us the failure it is. No one, and I mean no one should have the right to take our elected Magistrate's discretion away and threaten our public safety......
