So you have an employee who has been trouble for quite some time. What can you do? What are the legal issues associated with employee discipline and termination? “Fair Discipline”, written by Attorney Robert Gregg, outlines several legal issues. Here are just a few: 1. Just Cause: a standard for determining whether a situation requires discipline and for determining whether the discipline imposed was appropriate for the situation. For there to be just cause, disciplinary decisions must demonstrate fairness, honesty, good faith, and valid business reasons, without arbitrary, capricious or discriminatory actions. You can fire employees without discipline and still meet the Just Cause standard. Some examples are, if a company must lay-off employees for lack of business, company reorganizations or consolidations which eliminate jobs, and cost cutting measures. 2.Reasonably achievable: We shouldn’t discipline people who cannot reach unreasonable, unattainable high goals. Discipline should be applied to situations where an employee fails to reach “reasonably achievable standards”. 3. Reasonably related to operational needs: An organization’s rule or directive should be related to the orderly, efficient, and safe operation of the company’s business. It should also be enforced appropriately to the circumstances. 4. Within The Employee’s Control: Just Cause discipline cannot be served to employees who have no ability to do things differently, because they lack of control. For example, you cannot discipline salespeople for not making sales when the economy is depressed, and people aren’t buying. On the other hand, salespeople do have control over whether sales forms are filled out correctly and thoroughly. 5. Fair Warning: The employee must be informed, in advance, of performance expectations and codes of conduct. They must also have a reasonable time to achieve them. For example, if the employer has “cooperative attitude” as a performance expectation, then that term has to be clearly defined so the employee knows what it is. Or, if the employer has a rule against “excessive absences,” then the term “excessive” has to be clearly defined. There has been a significant increase in mental health and substance use issues since the start of the COVID pandemic. CARES Act funding will assist, but this alone will not solve the problems. There are many health issues caused by social isolation and lockdowns. The government needs to consider all aspects of health, not solely virus containment as we move forward. Research is clear on the effect of shutdown and social isolation on our nation's mental health, such as increased deaths by suicide and drug overdoses. The negative health effects are potentially long-lasting and very consequential for individuals and their families. The best fight we have against these issues is the safe reopening and return to some type of normalcy for Americans. With appropriate safety measures in place, the reopening of states and communities will facilitate the improvement in mental health across our nation. We cannot continue to ignore the health consequences for all other conditions in favor of singularly focusing on virus containment.
