New legislation in Illinois will impact the workplace and make employers and employees safer. Beginning on January 1, 2019, local criminal justice authorities will be able to charge certain stalking, cyberstalking and transmission of obscene messages as hate crimes.
Many times these types of crimes occur in or are initiated in the workplace. Inclusion of additional technology-based criminal activity provides additional protections to the victims of these crimes and will also provide a route for employers to keep their employees safe from harm. However, the legislation leaves open the question of how both employees and employers should respond to both internal and external threats and intimidation. Also left unaddressed in the new legislation is the potential liability of an employers in a civil action authorized by the statute where harm comes to one of its employees as a result of a repeated violation. It is always a best practice for employers to have a written policy so that employees know where to go and how to access assistance which may threaten the employees safety and the safety of others in the workplace.
