I get the same call repeatedly with the same issue over and over:
My spouse moved out of state with my child and I want my child back:
If the move was more than six months ago - the new state is the "home state" of the child and that is where you have to go to get visitation.
The lesson is: If your child was removed from the state and you are unhappy about it - you MUST go to court within six (6) months of the move or lose New York as the home state.
