Suppose you’re switching jobs if you were furloughed because of the pandemic or you’re simply searching for greener pastures. If you have a 401(k) from your soon-to-be former employer, you must decide what to do with your retirement account when you leave. ⠀ Here are your four options: 1. Leave the money in your previous employer’s pension plan. 2. Roll over the money to your new employer’s pension plan. 3. Roll over the money into an IRA. 4. Take the money and run. ⠀ So which of these options should you choose? Here are some things to consider as you think about what to do with your 401(k) account: ⠀ • Keep the borrowing option open. While you can borrow money out of your 401(k), that option is not allowed with an IRA. And if you leave your 401(k) at a former employer, they often will not let you borrow funds if you are not currently employed. ⠀ • Take the money. In a normal year, when you make an early withdrawal from a retirement account, you owe income taxes on the amount of the distribution plus a 10% early withdrawal penalty. In 2020, this 10% penalty has been suspended. So while you’ll still pay taxes on the distribution, you may be able to avoid the early withdrawal penalty. ⠀ • Invest the money. While it might be tempting to borrow or take an early distribution from your retirement account, you’ll also be depleting future earnings intended for your retirement years. So consider whether you truly need the money now to pay for an emergency or if you’re ok leaving it in your 401(k). ⠀ Whatever you decide, it is always best to transfer the funds directly from one retirement account to another. This direct transfer eliminates the possibility of your fund movement being characterized as a distribution subject to income tax. Fill the form with the name change and file it as soon as possible. - Also notify your employer. • The Problem: A payroll tax holiday effective September 1 was recently signed via a presidential executive order. Payroll tax holidays typically provide forgiveness of Social Security and Medicare taxes that are normally withheld from your paycheck. ⠀ This year’s tax holiday, however, is NOT necessarily a forgiveness of Social Security and Medicare taxes because the order is not yet supported by an underlying legislative action. So even if your employer removes your Social Security and Medicare tax from recent paychecks, there is a possibility you will need to pay it back at a later date. That could mean a pretty large tax bill for you in early 2021! ⠀ • What you need to do: ✔ Compare paychecks. If you notice that the amounts are different, or that no Social Security or Medicare taxes are withheld from your September paycheck, then that’s a signal you may have a tax repayment bill in early 2021. ✔ Remember to keep checking each paycheck. Payroll providers are trying to figure out how to comply, and everyone is wondering whether the tax obligation will be permanently forgiven. ✔ Be prepared to pay it back. If no Social Security or Medicare taxes have been withheld from your paycheck through the end of 2020, be prepared to write Uncle Sam a check to pay these taxes in early 2021. ✔ Check back here for updates. The Social Security Administration announced a 1.3 percent boost to monthly Social Security and Supplemental Security Income (SSI) benefits for 2021. ⠀ For those contributing to Social Security through wages, the potential maximum income subject to Social Security tax increases 3.7 percent this year, to $142,800. ⠀ ✔ What does it mean for you? • Up to $142,800 in wages will be subject to Social Security taxes, up $5,100 from 2020. This amounts to $8,853.60 in maximum annual employee Social Security payments. Any excess amounts paid due to having multiple employers can be returned to you via a credit on your tax return. • For all retired workers receiving Social Security retirement benefits the estimated average monthly benefit will be $1,543 per month in 2021 – an average increase of $20 per month. • SSI is the standard payment for people in need. To qualify for this payment you must have little income and few resources ($2,000 if single/$3,000 if married). • A full-time student who is blind or disabled can still receive SSI benefits as long as earned income does not exceed the monthly and annual student exclusion amounts listed above. ⠀ ✔ Social Security & Medicare Rates. The Social Security and Medicare tax rates do not change from 2020 to 2021. * Note: The above tax rates are a combination of 6.20 percent Social Security and 1.45 percent for Medicare. While the CARES Act spelled out that a business’s forgiven PPP loan would not be considered taxable income, the legislation was silent about how to treat expenses paid for using PPP loan proceeds if the loan was ultimately forgiven. ⠀ Congress intended for these expenses to be deductible for federal tax purposes. But since the legislation was silent on this issue, the IRS swooped in and deemed these expenses to be nondeductible. ⠀ There was considerable debate over the latter half of 2020, with Congressional politicians explaining that their intent was that the expenses be deductible and the IRS responding “Too bad, they’re nondeductible.” ⠀ ➡️ The Solution. Congress overruled the IRS’s position in the Emergency Coronavirus Relief Act of 2020. Until you file your tax return, the IRS does not know whether you need to pay more in or they need to refund you the excess amounts withheld. ⠀ Thieves know this too, and will try to file a fraudulent tax return before you have time to submit your own. So what can you do? 1️⃣ File early. The sooner you file your tax return, the less likely a thief will beat you to your refund. 2️⃣ Get an Identity Protection PIN. The IP PIN is a six-digit code known only to you and the IRS that helps prevent identity thieves from filing fraudulent tax returns. 3️⃣ Check your credit reports. See if there is any suspicious activity on your accounts. 4️⃣ Protect your ID. Be suspicious. Never give out your Social Security Number, do not leave your credit card unattended, never give ID information to someone who called you, be aware of strange mail, and shred important documents. ⠀ 📌The IRS is becoming a better spotter If the IRS suspects something is wrong with your filed tax return they will send you a notice. If this happens to you: • Respond immediately. • File an Identity Theft Affidavit (IRS Form 14039). This will record your problem with the IRS and they will take extra steps to ensure your account activity is coming from you and not the ID thief. • File a police report. • Contact the credit bureaus. ⠀ Having your identity stolen is one thing. Having your tax withholding stolen and then needing to unravel this problem within the IRS is a major hassle. W-2 and 1099 forms are some of the most common tax documents to go missing. It’s easy to lose track of all these documents if you don’t have one place you put them once received. ⠀ Can I still get a stimulus payment❓ If you’re still waiting on either the 2020 or 2021 stimulus payment, file your 2020 tax return and claim the Recovery Rebate Credit. Specifically, the first $10,200 of 2020 unemployment compensation or as much as $20,400 if your spouse also received unemployment is now tax free. The benefit is for households with adjusted gross income under $150,000. Depending on your tax bracket, this tax break could mean $1,200 or more in taxes saved on your 2020 return. ⠀ ➡️ The problem. The legislation which contains this tax break didn’t become law until March of 2021, three months after the end of the tax year and after millions of Americans already filed their 2020 tax return! ⠀ ➡️ The result. • Tax filing delay. You now have until May 17, 2021 to file your 2020 individual tax return and pay the tax. This move from the traditional April 15 filing deadline DOES NOT impact first quarter estimated tax payments or extended filing due dates in September and October 2021. • Tax-free unemployment income. If you received unemployment compensation in 2020, here’s what you need to know: - If you’ve already filed your 2020 tax return: Wait for further instructions. Lawmakers are currently asking the IRS if it’s possible to automatically make adjustments and issue a refund if you’ve already filed your 2020 return. - If you HAVE NOT filed your 2020 tax return: Filing your tax return will be delayed until guidance is received from the IRS and it is deployed into tax filing software.
