This decision was issued by the Commonwealth Court yesterday. They found that failing to file a document accepting my client’s injury within 21 days of his notice to them was a violation of the Workers Compensation Act and required the insurance company to pay my attorney fees as a penalty for what is known as an unreasonable contest.
This decision makes precedent in the Commonwealth of Pennsylvania for all insurance companies to file these documents or suffer the same penalty of having to pay attorneys fees for an unreasonable contest.

Douglas Amicus Curiae Award for his outstanding appellate advocacy as an Amicus Brief Writer primarily on important Workers’ Compensation topics before the Commonwealth Court and Supreme Court of Pennsylvania.
He received his Bachelor of Arts Degree from Kings College in 1975 in government and politics, his Juris Doctor degree from the Villanova University School of Law in 1978, and also earned a Master of Arts degree in Creative Writing in 2006 from Wilkes University.
He has been practicing law in Wilkes-Barre since 1978, and in addition to Workers’ Compensation, his law practice also includes representation of injured people in auto accidents, trucking crashes, defective products, Social Security Disability, and Federal Black Lung claims.
