ADVICE FOR SMALL BUSINESSES RETURNING TO THE “NEW NORMAL”
There are a variety of issues that small businesses need to address as they prepare to reopen on May 15, 2020. SIGNIFICANT CHANGES TO MICHIGAN’S NO-FAULT LAW TO TAKE EFFECT JULY 1, 2020.
In June, the Michigan Legislature made significant changes to Michigan’s No-Fault Law which go into effect on July 1, 2020. These changes will allow insureds to “opt-out” of coverage for allowable expenses which should, theoretically, reduce premiums (but we have heard that before). Currently, if you are involved in an accident, you are entitled to lifetime benefits for allowable expenses from your insurer. Beginning July 1, 2020, insureds will be offered options to limit these expenses to $50,000; $250,000; or $500,000; depending upon the coverages that you select. This means that if you are involved in an accident and suffer severe injuries, your coverage for allowable expenses will be limited to the option you select. (You still have the option to select lifetime coverage, however.) You should seek legal advice so that you understand the consequences of “opting out” of lifetime no-fault benefits, and make an informed decision about the best coverage for you, your family, or your employees.
