Q: Do I have to do anything different when settling a personal injury claim if I am under 18 years of age?
A: The short answer is “yes.” The law provides that a minor’s settlement is not enforceable until the court approves the settlement. When a minor settles a personal injury case, the court wants to look at the amount of the settlement and how much the lawyer is charging for his or her services. If the court finds the settlement to be fair and the fees to be reasonable, it will be approved. This approval can be sought by filing a “petition to approve a minor settlement” pursuant to Alaska Civil Rule 90.2.
