The Supreme Court on Re-Opening Criminal Convictions to Prevent Deportation
The U.S. Supreme Court has decided to hear the Texas court case about deferred action for parents. This means the Court will issue a decision by the end of June.
If the Court agrees with the Obama Administration, this means USCIS will resume preparing for implementation of the deferred action program for parents of children who are US citizens or lawful permanent residents. I expect it would take at least 2 months for USCIS to be ready to accept applications.
Today, we received a notice of approval for a U visa. The client had to wait 27 months for approval. Unfortunately, the government can only provide 10,000 U visas each year. That figure includes not only the person who was the victim of crime, but also to any eligible member of the family that apply with him or her. These other family members drastically affect the availability of the U visa, so now people often have to wait two years for a decision. But we're glad that the client is finally on a path to a green card.
