Uber finally having to face the fact that their drivers are employees! But, who is an employee in California? In Dynamex v. Superior Court, the California Supreme Court adopted the “ABC" test to determine coverage under existing Industrial Welfare Commission Wage Orders. Under the ABC test, anyone that performs services for another is assumed to be an employee, unless all three of the following "ABC" test requirements are met:
1. The worker must be free from the control and direction of the employer in connection with the performance of the work;
2. The worker must perform work outside the “usual course” of the employer’s business;
3. The worker must be customarily engaged in an independent established trade, occupation, or business of the same nature as the work performed.
