Judge Hudson’s overall survey results were positive. Attorneys rated him highly for conducting himself in a manner free from impropriety, being knowledgeable about substantive law and rules of procedure and evidence, being attentive to the proceedings, maintaining proper control over the proceedings, being prompt in scheduling hearings and trials, and displaying familiarity with court cases through prior preparation. Why should my medical or financial power of attorney name an alternate agent?
At Bristol Law Office, we believe in not just having Plan B, but Plan C, just in case. We know of a case where a husband and wife just named each other as agents; no alternate agents were named. The wife’s dementia ultimately lead to her being placed in a nursing home. So far so good, but then the husband had a stroke and became incompetent. Because they did not list alternate agents, their families were in a bad situation. It is important to always name alternate agents.

What does it mean, New Mexico is a “no fault” divorce state?
New Mexico was the first no fault divorce state in the country. Then Nevada became no fault and lots of people would go to Las Vegas for “quickie” divorces. NM did not want to be known for quickie divorces and started a requirement for 6 month residency to file for divorce. “No fault” simply means no one has to be at fault for the divorce; you can get a divorce just because you want one. It also means there is no ‘fault’ stage in the process. The judge is not going to find someone did something wrong. No one is going to be labeled as the bad guy. Assets are divided 50-50 even if someone cheated on their spouse or was a drunk or drug addict; there is no ‘fault’ so the assets are divided 50-50 regardless of any bad behavior. Bad behavior can have an effect on custody issues, however.

If the debts were made after the date of marriage, then your spouse is liable on them because we are a community property state. All debts made after the date of marriage are owed by both spouses. Whether she needs to file bankruptcy with you or not is actually an asset question. If your list of protected assets protects all of your community property, then you can file without her.
For child visitation for the holidays, let’s all remember that everyone else is stressed out, too. Please remember this should be a happy time for children. Use a little extra patience with your ex. Take a deep breath before responding to what you may think is a snotty text but may not have been intended as one. Put the children’s happiness first. Yes, they really are happy visiting the other parent. Kindness can go a long way.

I am still paying on my house mortgage, but who owns it, me or the bank?
This is a common question. To compare:
1. Buying on a real estate contract: buyer does not get a deed until after the last payment. But buyer should record a notice that they are buying it so the seller does not sell it out from under them.
2. Buying with a mortgage: the buyer gets a deed. Then the buyer gives the lender the mortgage on the house as a lien to secure the promissory note. You are the owner of the house (with a deed); the mortgage is just a lien on the house. All deeds are recorded with the County Clerk.

Do I really need an #estateattorney ? I mean, I can get a Will off of the internet and then my family avoids a probate, right?
If it were only that easy. First, a fill-in-the-blank form does not work in NM. Second, just having a Will does not keep the house out of probate, for example. Why not? Because to transfer the ownership, someone has to sign a deed. And if you are dead, you can’t sign. Your family will have to go to probate court, be appointed executor, in order to have authority to transfer the house. An #estateattorney (like us) can fix that problem for you.
