The California Cannabis Agencies have released emergency regulations to allow financial institutions to obtain information regarding licensees to help facilitate banking services. Please note that the regulations require a waiver of confidentiality and privilege. We will see just how far the waiver extends once the regulations are published to the OAL. SB59 extends the ability for the licensing authorities to issue and renew provisional licenses through 2028. No doubt, we need a solution that allows our industry to continue to operate legally and while licensed and this is unlikely to happen by December 31, 2021. The thing is, other than some municipal agencies struggling with CEQA for their cultivators, there is no explanation as to why the #BCC and #CDPH have not been issuing annual licenses instead of provisional licenses. Did you know that you have no appellate or due process rights under the provisional licensing scheme? Did you know that if the BCC or another agency decides to revoke your license FOR ANY REASON (not even a good or reasonable one) that you have no right of appeal. Right now the BCC is sitting on millions of dollars worth of seized product and refuses to transfer it back through distribution or to provide hearing rights if your license is revoked. Recently, James Anthony, Esq. stood up to the BCC on behalf of Harrens Lab. In response the California Attorney General took the despicable position that because cannabis is federally illegal, and commercial cannabis activities are a “criminal offence” under federal law, thus, licensees have NO PROPERTY RIGHTS IN THEIR BUSINESS OR INVENTORY and thus NO DUE PROCESS protections. This should have the entire industry up in arms! This is AMERICA!!! Due Process is the foundation of our Constitution. The State of California has happily taken and, dare we say taken to its knees, the cannabis industry and market place; it has happily taken our tax dollars and spent them on enforcement rather than ensuring all who wish to participate in the legal market can. And now, the Attorney General and the California Legislature have the audacity to ask us to cover their asses while they refuse to duly process annual licenses. We have clients who have had CEQA compliance since 2018 and the BCC still cannot articulate why they are on an annual license.
