DUI Defendants can Finally Serve Jail Time at Home
On July 22, 2020, the Maricopa County Board of Supervisors finally authorized home detention for misdemeanor DUI Defendants charged in Justice Courts. This comes after many years of unfair and disproportionate treatment for DUI Defendants throughout Maricopa County. Years ago, the legislature recognized that current misdemeanor DUI sentences in Arizona are extremely harsh compared to other misdemeanor crimes, and even compared to DUI sentences in other States.

DUI Defendants can Finally Serve Jail Time at Home
This year, a ballot initiative called “Second Chances, Rehabilitation, and Public Safety Act” has real potential to enact the changes many Arizonans want. The petition must get 237,645 signatures by July 2, 2020 to make it onto the 2020 ballot in November. Once on the ballot, the decision to make necessary change will be in the voter’s hands.

Arizona’s Second Chances Act: A 2020 Ballot Initiative aiming to benefit all by ending mass incarceration, rehabilitating non-violent offenders, and reducing the $1.2 billion burden on taxpayers
With the ongoing concerns of the spread of COVID-19, you may be wondering what precautions are in place to prevent an outbreak in Arizona’s prisons. The Arizona Department of Corrections recently announced it will lift the $4.00 charge for requesting healthcare if an inmate has Coronavirus symptoms and will also lift the inmates’ charge for soap temporarily. However, according to the ACLU of Arizona, Arizona’s incarcerated population still cannot adequately social distance, have limited access to basic hygiene products, and have limited access to medical care.

The word on the street is that Maricopa County Inmates have a new way of “Getting Out.” No, not literally, but figuratively speaking, Maricopa County through a third-party vendor “GTL” has set up tablets for inmates to utilize for purposes of maintaining and re-building relationships with loved ones.

Reconnecting with your inmate
Due to the Coronavirus COVID-19 pandemic, many courts in Arizona have been modifying their instructions for defendants, criminal procedures, courtroom policies, and safety protocols. These changes arose after the Chief Justice of the Arizona Supreme Court implemented temporary measures beginning March 16, 2020 and ending April 17, 2020 in order to mitigate the Arizona community’s risk of exposure to Coronavirus. These temporary measures included halting new jury selection, which means that no new jury trials will be started during this time period. However, unless the specific court or your assigned judge to your case orders otherwise, all other court proceedings will continue as scheduled with additional safety procedures in place.

How does the Coronavirus affect my Arizona Criminal Case?
The holidays traditionally are a time of peace and joy, but often result in stress, over-shopping, and overindulgence. Unfortunately, the number of shoplifting and alcohol related crimes tend to increase during this time of year too. Some of us fall to the pressure of obtaining gifts we cannot afford and resort to shoplifting. Other simply make errors in judgement due to distractions and stressors of the season. Examples of these errors include forgetting to pay for the gifts you put in your reusable bag or the items you stored on the bottom of the cart. Still others forget to scan items at the self-checkout. Whether intentional or not, these errors can lead to Shoplifting charges.

STAY OFF THE NAUGHTY LIST FOR THE HOLIDAYS THIS YEAR
Proposition 207 is known as the Smart and Safe Act; the proposition calls for marijuana to be legalized for recreational use for adults 21 years old and older. The proposition allows possession of up to 1 ounce of marijuana, with no more than 5 grams being marijuana concentrate, and allows growing up to 6 marijuana plants in the home.
