How to win a small claims court lawsuit
Someone on my video channel asked me for my top 5 tips for new law students. Here it goes - I have my own general tips. They make not work for everyone, but worked for me.
1. I always got the bar review tapes BEFORE a class started. For example, before contract course, I took two weeks to review/outline listening to the bar review tapes (I am an audio/visual learner). When I walked into class, while everyone was fumbling around I knew what was going on, what was bar tested, and what was professor philosophising. I passed the CA bar exam (first time, and did not take bar review or panic at bar test day). Using this approach....
2. I did not need study groups. I did not like wasting time. I put in my own work the best I could at each class. Some classes I wasn't great at (ex. Wills and Trusts but oh well).
3. Make sure to tax time to exercise and eat right. This is an endurance sport.
4. I liked listening to classical music while I studied (some studies suggested this helps with memory). Not sure if this helps, but it did for me.
5. Have fun. Mingle with other students. This is a great undertaking so get to now other people. You will become colleagues in the future. Don't spend too much time talking after exams, when everyone freaks out about "I spotted this, or didn't spot that." It's okay, you not going to spot everything. But, truly enjoy this great time in life that is my tip #5.

Did you catch Corona Virus after riding on Uber or Lyft?
It never ceases to amaze me how you can schedule a ride to your local restaurant or sporting event on Drive sites like UBER or LYFT, and recently my wife "Frontline Lisee" booked such a trip through Uber.
Their app immediately informed her to MEET THE UBER DRIVE OUT WITH A MASK ON (Covid mask obviously). Which is fine, but as a civil litigation attorney, this got me thinking, WHAT DOES UBER DO FOR YOU AS FAR AS PROTECTING THEIR RIDERS from catching the Covid or Corona virus?
I asked my wife to make sure to ask the driver for the following questions so that her safety and our safety is protected to the extent we can:
1. When was your last trip where you drove a rider?
2. Was the rider wearing a mask?
3. If no, why not?
4. Was the vehicle sanitized after the ride? If so, in what ways. If not, why not?
5. To the driver: Have you been tested for Covid-19? If so, when was the last time?
6. Do you have any reason to believe anyone you drove today may have had a cold or virus? If so, what do you know?
7. In the last 48 hours, has anyone in your vehicle have a hard time breathing?
8. In the last 48 hours, has anyone in your vehicle had a cough that concerned you? If so, when and why?
9. How often do you sanitize your vehicle?
10. What steps, including products, do you use/undertake to make sure your car is not causing any risk to public health and safety? Please be specific.
This may be an uncomfortable line of questions for many, I realize that, but when it comes to your health and safety, and that of your family, friends and others, these are common sense questions.
If the driver will not answer these no-nonsense questions, personally, I would not take the ride. So, while it is nice that UBER and LYFT may ask YOU to wear a mask before using their service, YOU DO HAVE THE RIGHT TO ASK THEM QUESTIONS THAT PERTAIN TO YOUR SAFETY and which seek to slow the spread of this nasty virus.
Here is a simple printable questionnaire I created which you may want to provide to your driver, or at least ask the questions. This disease is too damn serious than to just trust a stranger driver and his/her car.
