Lately, there has been some confusion about who has the power to order citizens to shelter in place, to ban public gatherings and to shutter businesses (and of course there is the matter of who can lift these orders).These questions center on the age-old debate of state versus federal powers. For answers we can look to our Bill of Rights.
The 10th Amendment reads “The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.”
These reserved powers encompass what is known as “police powers”. Police powers give state governments the ability to enact laws to protect or promote the public health, safety and welfare.
