Many clients come to me with the belief that everyday words cannot be granted with trademark protection. Classic legal answer, "it depends". Think of words like "air" and "black" - these are 2 examples of words that also function as trademarks in apparel. This Mark Jacobs case is interesting. It's not the mere fact that the word "the" is too basic of a word to trademark, rather a combination of failure to function, merely ornamental and unmatched specimens causing the problems. If I represented Marc Jacobs, I would recommend using several functional representations of "the". I'm seeing an intersection filled runway formed out of "the", "the" shaped hangtags on the sweater, and a perfume named "the" with a black and white commercial that is silent, except for when Lila Moss whispers "the" at the end.
