Legal News: No Bail During Appeal
A law goes into effect today that prevents courts from granting certain sexual offenders bail while waiting for an appeal. If the defendant was found guilty of a crime that requires them to register as a sexual offender or sexual predator and the victim was a minor, they are no longer eligible for bail during their appeal.
The bill came about when a 10-year-old little girl’s mother ran into her daughter’s abuser at Publix. He had just been found guilty of molesting her daughter and was released on bail while he appealed his conviction.

Legal News: Deadline Looming for Boy Scout Abuse Victims
Since early 2019, thousands of victims have been coming forward about what they were forced to endure while a member of the Boy Scouts of America (BSA). The wave of allegations spiked in February 2020 when the BSA filed for bankruptcy.
Bankruptcy was imminent after past sexual abuse settlements strained the groups finances. Several states passed laws allowing victims to sue for damages despite the statute of limitations, but now the courts have set a deadline for November 16, 2020. After the November 16th deadline past victims will likely be unable to ever file charges against the BSA.
If you need assistance with your potential lawsuit against the Boy Scouts of America or just want to ask us some questions about the class action lawsuit, please call us at 407-254-4901 or text us at 407-644-4444. We understand that this can be a difficult thing to discuss, but we will be by your side and there to help you in every step of the process.

Legal Tip: What are the Key Differences Between a Settlement and a Trial?
When you file a Florida personal injury lawsuit you are counting on your attorney to get you the best possible outcome for your case. Sometimes that outcome ends with a settlement and sometimes the outcome ends with a trial – and there are pros and cons to both.
A settlement is an agreement to accept the financial compensation the defendant offered in exchange for ending your lawsuit. A settlement can occur at any point during litigation but before the jurors reach a verdict. Once an agreement is reached you will receive your payment and be required to sign a document saying you understand that you can no longer sue the defendant for matters related to this lawsuit. The primary con to a settlement is you typically get less compensation than you would have if you had gone to trial.
The jury may reward you more money than the defendant was offering. The risks with going to trial include the fact that you aren’t guaranteed to win anything, they are very stressful and expensive and can last for a very long time.
Your attorney should never be afraid to take your case to trial if that is what is best for you; however, a settlement if often a faster resolution and takes months to come to whereas a trial could take years. Determining whether you case should settle or go to trial will depend on the circumstances of your case, the decision you and your attorney come to, and how willing the defendant is to negotiate.
Legal News: Increase in Pet Buying Could Lead to More Dog Bite Injuries
The pandemic forced a lot of people to make changes in their lifestyles and their day-to-day habits. A common lifestyle change that many Floridians participated in was getting a new dog. There was a spike in the number of dogs that were fostered or adopted since the pandemic started. Many people take comfort in their pets during a trying time in their lives. However, with that comfort sometimes comes pain: A surge in Florida dog bite injuries.
With everyone being in quarantine, kids doing virtual school and parents working from home, people were spending more time with their dog and spent more time outside walking their dog - this increased the potential for dog bites. Additionally, many people who got new dogs during the pandemic had a difficult time getting them socialized or trained due to everything being closed down which could also lead to an increase in dog bite cases.
According to dogsbite.org, 4.5 million dog bites occur each year across the United States. Homeowners insurers paid out $797 million in liability claims related to dog bites and other dog-related injuries in 2019. That number is sure to grow with the 2020 statistics given the number of new dog owners.
If you or someone you know was bitten by a dog, please reach out to us to discuss a potential civil suit so you can be compensated for your injuries and medical treatment.

Legal Tip: Laws Involving Emergency Vehicles
Florida has the “Move Over Law” that requires drivers to move over to the other lane, when it is safe, whenever passing a stopped law enforcement officer, emergency vehicle, sanitation worker, utility service vehicle, and tow truck driver or wrecker. If the driver is unable to move over to the other lane then the driver is required to slow down to a speed that is 20 mph below the posted speed limit.
Yielding at intersections is also required for emergency vehicles. If you are at an intersection and you have a green light but an emergency vehicle is approaching from behind you then you should get in the right lane as close to the curb as possible and stay there until the emergency vehicle passes. If the emergency vehicle is not coming up behind you then you should just stay where you are until the emergency vehicle passes through the intersection.
