RE: Dr. Weiner’s patients
To Whom it May Concern:
We received a memo from “St. Peter’s Health Leadership”. It looks to have been created by St. Peter’s Health on November 24, 2020.
Clearly, the letter from the Health Leadership of St. Peter’s is in error, grave error. Contrary to the letter, clients have been telling us that appointments have been abruptly concluded without notice or rescheduled for months out from the previous appointment. Some have been cancelled altogether and patients were told that they have to see their primary doctor and can not be seen at the Cancer Center any longer. Prescriptions are not being renewed in time. Wrong prescriptions are being prescribed or new prescriptions are being prescribed without seeing the “new doctor” at St. Peter’s. Full prescriptions are being refused to be renewed for the normal length of time (for example a three-month prescription is being reduced to one month) causing patients from out of town extra difficulty in getting these prescriptions filled. Many patients do not have a primary doctor and while the hospital has promised to find another primary care doctor, that has not occurred for several patients. There are limited doctors in this town, and they can only accept so many patients and the follow-up has not been on the hospital’s part. It has been the patients that have had to push to get in to see other doctors at the hospital as promised to them. All of these situations have been highly concerning and unsettling given the very vulnerable population of cancer patients at the hospital cancer center serves. Patients are also telling us that the oncologist brought in by St. Peter’s management openly say that they are just temporary. They struggle giving advice to these cancer patients and tell them it is difficult because they are unsure of what care to give.
Dr. Weiner’s patients are telling us a much different story and the lawsuit we have filed will reveal that there was no plan and the hospital is now struggling to catch up and come up with a post-facto plan. The hospital has thrown these vulnerable cancer patients to the wolves, frankly.
The CEO and the hospital’s actions have not been well planned. They have thrown Dr. Weiner’s patient population into complete unplanned turmoil with no real regard for the patients at all. This recent article by the CEO and the Health leadership, is nothing more than a publicity stunt to cover up the facts of this case in the public’s sphere.
It is easy for the hospital to tell the patients that they may “rest assured” but they are not assured, and they have not been assured and they have not been treated well for their medical needs. We encourage all of these patients to let us know the problems that they continue to have with their needs for care and the problems they have had getting that care.

Dear Mr. Johnson:
Our law firm represents many current patients, family members, and former patients of Dr. Tom Weiner. These patients of Dr. Weiner have been damaged by your actions, by locking Dr. Weiner out of his office and talking about it in the press. Your actions have caused a great deal of anxiety, increased depression, headaches, and economic damages for many, and we are talking about hundreds and hundreds of patients and their families.
We intend to file a class action shortly alleging these damages and harms that my clients have suffered. I think the only way to abate that is for you to open the door again for Dr. Weiner so that he can resume caring for his many patients. I’m sure that you may think that you have sufficient reason to have treated your employee, Dr. Weiner, the way you have treated him. However, I doubt that you will be able to prove that, based upon what I know. I think that it is impossible for you to prove that his care, his ongoing and continuing care for his patients, posed or poses an imminent threat of harm for these patients. I have several patients who are concerned about the care that they are receiving from other doctors at St. Peter’s and they wonder whether these doctors are going to be similarly treated if they get crosswise with administration. I know for a fact that there hasn’t been any meeting with administration and Dr. Weiner to discuss concerns that administration may have had. As an employee, he is entitled to all the rights that exist within the employee handbook. Again, as I have read the legal requirements for such abrupt action by administration, there has to be imminent threat of bodily injury and harm that would be suffered by these patients in order to take the precipitous action that you did. Because of your precipitous action, my clients have been harmed by you, not Dr. Weiner.
I am certain your response will be that you can’t talk to us about your reasons or what is behind the closed doors, and that we will have to go ahead and start litigation. I can tell you that once we start, we are not going to walk away from this, and if indeed we are correct, that you can’t demonstrate imminent and serious harm to my clients for your actions, then so be it. If there is anything that you can provide me to cause us to reassess our position, please let me know immediately. You have my telephone, email, and address.
