HOW IS A GUARDIAN APPOINTED IN NEVADA?
In Nevada, the court first decides on whether or not a guardianship should be granted. The process starts with the filing of a petition requesting the guardian appointed. Most importantly, a physician will also need to provide an evaluation indicating that the person by reason of mental illness, mental deficiency, disease, weakness of mind or any other cause, is unable, without assistance, properly to manage and take care of himself or herself or his or her property, or both. The term includes a person who is mentally incapacitated.

In a recent unpublished California Court of Appeals decision, a daughter challenged her father’s execution of a new deed. The deed previously reflected that the father owned a piece of real property in Chula Vista, California as tenants in common with his sister.
Approximately one week prior to the execution of the deed, the father had been admitted to the hospital with respiratory problems.
Shortly thereafter, he died and the property transferred to the surviving joint tenant by operation of law. If the deed was invalid, then one-half of the property would’ve been transferred to the daughter through the probate process.

Reuters recently reported that a new study found physicians wrote significantly fewer prescriptions for painkillers and other medications for elderly and disabled patients who had legal access to medical marijuana.
