On the first Wednesday in October, National Coffee with a Cop Day brings men and women in uniform together with their communities to connect over a cup of joe. Inspired by the cliche about officers and their coffee shop donuts, the national observance encourages communities to sponsor an event that will bring citizens and those on patrol together. Our hearts go out to the Boulder community members and Boulder Police tonight as they grieve this tragic shooting. Our thoughts are with the families of those who lost their lives today and to the police officer who made the ultimate sacrifice. We stand with you.
A BILL HAS BEEN INTRODUCED CONCERNING THE ADOPTION OF WRITTEN POLICIES BY LAW ENFORCEMENT AGENCIES FOR CONSTITUTIONALLY REQUIRED PEACE OFFICER CREDIBILITY DISCLOSURE NOTIFICATIONS.
If passed, this bill would require a law enforcement agency to provide a credibility disclosure notification to a district attorney's office if a peace officer's credibility is called into question by an internal investigation, an allegation, or a sustained finding.
The bill outlines conduct that a law enforcement agency must report to a district attorney's office. It would require the law enforcement agency to provide notification to the involved peace officer at least 7 calendar days prior to sending the credibility disclosure notification to the district attorney's office, except under specific circumstances.
The bill would also require a district attorney's office to adopt written policies and procedures for receiving and maintaining these credibility disclosure notification records. The district attorney's office would determine whether a record must be created based on a law enforcement agency's credibility disclosure notification. The policies and procedures created by the district attorney's office to include a process to notify defense attorneys and defendants of the creation of these credibility records, as well as a process to remove any such record found to be inaccurate or false by the court or by the relevant law enforcement agency.
This bill has not yet passed and is not yet effective, but all law enforcement officers should stay apprised of the progress of this bill, since if passed, it will change the way Brady determinations and Brady letters are currently being handled by district attorneys throughout Colorado.
