Litigating Divorce and Custody Issues During Coronavirus Although Coronavirus has restricted us in our homes, except for the occasional food shopping excursion, a family law litigation matter can still be filed, discovery can still be conducted, depositions can happen, mediations can occur, and negotiations to settle domestic cases are still occurring. In fact, most domestic relations matters are negotiated or mediated -- and then resolved -- without going to court. However if litigation of a family law issue (divorce, custody, financial support) is necessary for your situation, this can still happen. Despite public closure of the courts, courts are staffed and are accepting new divorce filings so that disputes can be addressed and hopefully resolved in a timely fashion after the courts reopen (some matters are even being treated by the courts as an emergency and addressed immediately by video conference). While business and life in general has been asked to step back until the pandemic is abated, now is a good time to try to resolve your disputes. How can I prove my spouse committed adultery? You don't have to catch your spouse in the act to prove adultery. While a good private investigator can be worth his weight in gold, most adultery claims are proven by circumstantial evidence: Disposition such as public displays of affection or romantic emails or greeting cards; and opportunity, such as frequent private late-night visits to paramour's residence or joint trips. What should you be looking for to confirm your suspicions? Credit card receipts, photographs, social media posts, travel itineraries (e.g. airline ticketing receipts), cell phone bills, and emails may be helpful in confirming the suspected behavior. Interestingly enough, a party's admission to adultery, by itself, usually is not sufficient proof because courts are concerned if there is collusion being attempted to avoid divorce grounds that require waiting periods. However, in a contested divorce case an adultery admission by a spouse may be enough to corroborate the adultery allegation.
