We are living in difficult times. The pandemic has created uncertainty. Many are struggling financially and while others are doing ok because of government stimulus and other assistance. The concern is the future. Bankruptcy should not be entered into lightly and is often the last option anyone wants to consider. There are factors and questions to be asked to determine if bankruptcy is a viable option. • Are you having to use retirement accounts or savings to pay bills and living expenses? • Are you having to use credit cards on a regular basis to pay living expenses? • Are you only able to make the minimum payment on your credit cards, so the balances are never going down? • Are you behind on your mortgage, your rent, your car payment or other secured debt? • Are you taking cash advances on credit cards or transferring balances from one card to another to try to stay ahead? • Are late fees and interest increasing on your debts thereby increasing the balances even though you're attempting to make payments. • Are you taking out loans or home equity lines to pay credit cards or other debts? • Are you being threatened with legal action to collect debts or being threatened with foreclosure or threatened with repossession? It is a good idea too examine your overall financial health by asking these questions. If you answered yes to two or more, it may be time to consider options before things get worse. Bankruptcy is a difficult subject to discuss but it is worth discussing just like any other financial discussion so that all options can be considered so the best option can be chosen. Having more knowledge concerning options allows you to make the best decision. Bankruptcy can help with the following: • Stop a foreclosure and help reorganize to catch up payments that have been missed. • Stop a repossession and help reorganize to catch up payments that have been missed and may allow for the retrieval of a vehicle that has been repossessed. • Stop debt collection efforts, stop creditor harassment and phone calls so that you can live in peace without the threat of legal action. • Avoid judgments from being entered against you and eliminate judgments that may have already been entered. • Eliminate unsecured debt such as medical bills, credit cards and personal loans. • Protect your property while eliminating certain debt or reorganizing certain debt so that you have more money available to pay living expenses. THERE IS HOPE, THERE IS A SOLUTION.
