Unanimous Jury Verdicts now required in Oregon.
On April 20, 2020 the United States Supreme Court issued its decision in the landmark case of Ramos vs Louisiana. The court addressed whether the United States Constitution requires unanimous jury verdicts in criminal cases. At the time of this decision, only two states (Oregon and Louisiana) continued to allow non-unanimous jury verdicts. Under Oregon law (prior to Ramos) an individual could be found guilty if 10 out of 12 jurors agreed on a verdict. Ramos however, now requires unanimous jury verdicts to find individuals guilty of crimes. This is a major victory for all citizens, and particularly beneficial for criminal defendants and criminal defense attorneys. Under Oregon law a finding of “guilty” requires all 12 jurors to agree. However, a finding of “not guilty” presently requires only 10 jurors. If you are facing criminal charges, remember that you have a right to a jury trial, and now that right means the right to a unanimous jury as well.

2020 was rough! Don’t lose your vehicle as well.
In its first opinion in 2021, the US Supreme Court clarified an issue regarding the impact of the Bankruptcy Automatic Stay. Unfortunately, this decision was not helpful to debtors. In fact, the decision overturned a long-standing 9th Circuit Court “rule” that required a creditor to immediately return repossessed vehicles upon the filing of a Chapter 13 bankruptcy case.
So, what does this mean for debtors struggling to pay their debts? First, it means that if you wait too long to file a bankruptcy case, it may become difficult if not impossible to recover your property once it has been repossessed. Second, it means that if you are behind on your vehicle payments (or payments on other property that can be easily repossessed), creditors may become more aggressive than before. Third, it means that you should not wait to speak to a bankruptcy attorney if you are struggling financially.
