#ThursdayThoughts Ron Herman was recently asked about his community involvement and the reasons behind it. It was a good discussion and highlighted a key point: get involved for the right reasons. Time is a precious resource and devoting your energy to a cause you believe in should be the driving force. A year ago, Ron completed his tenure as Chair of The Florida Bar Grievance Committee, where he worked with other esteemed committee members to protect our legal profession. He was grateful for the appointment by Ron Ponzoli of the Florida Bar Board of Governors, and for the opportunity to work with old friends and make new connections with like minded professionals.

Ron Herman was presented with this Meritorious Public Service award for his service on The Florida Bar Grievance Committee (15th Cir “A”). In 2017, Ron was appointed to this esteemed Committee by Fla Bar Board of Governors member Ron Ponzoli, and was named Committee Chair earlier this year. The Committee is tasked with investigating possible lawyer misconduct and recommending disciplinary actions. Congratulations!

Because Palm Beach County has issued an order allowing playgrounds to reopen, the Wellington playgrounds will be open effective 5:00 p.m. today, Thursday, August 27.
Importantly, Covid-19 has not gone away. While the Village will do its best to keep the playgrounds clean, parents use them at their own risk. Be smart. Be safe. Social distance. Wash or sanitize hands frequently. If the playground is crowded, maybe come back later.
The State of Florida lost its appeal in the Robert Kraft case in a win for Constitutional rights! The spa recordings police obtained by using the controversial "sneak and peak" warrants can't be used. As Ron Herman previously opined, this type of surveillance is extremely intrusive and should be rarely used. In fact, the appellate court concluded that this "type of law enforcement surveillance utilized in these cases is extreme."

UPDATE: Appellate Court rules in favor of Robert Kraft: "total suppression of the video recordings was constitutionally warranted." Fourth Amendment rights against unreasonable search and seizure prevailed and preserved.
Looking back at Ron Herman’s interview by The New York Times about another high profile case. Today, the case is on appeal after Kraft won his motion to suppress police surveillance video from hidden cameras. If the state loses the appeal, the solicitation case will likely fail too. And as acknowledged in the prosecutors’ brief to the Fourth District Court of Appeal, no human trafficking charges have been brought to date.

UPDATE: Federal grand juries are resuming November 16, 2020 in the Southern District. Federal jury trials are still pushed back until at least April, however.

Ron Herman first got involved in local government when he was appointed to the Village of Wellington Florida Public Safety Committee. Going on to serve as the Committee Chair and Vice Chair, Ron tremendously enjoyed working together to bring new initiatives and raise community engagement. Most cities and other local governments have these advisory boards and committees and we highly recommend that residents get involved and actively participate.

On January 25th, Palm Beach County Fire Rescue units presented a Cardio Pulmonary Resuscitation (CPR) demonstration to the Village of Wellington Public Safety Committee at Village Hall. Engine 30, Rescue 30, EMS 28, Battalion Chief 28, and District Chief 28 attended the committee meeting and demonstrated the department’s capabilities with a cardiac arrest scenario. Staff Captain Sebastian Garay from the Rescue Division narrated the demonstration after presenting Palm Beach County Fire Rescue’s cardiac arrest protocol and explaining the importance of bystander hands-only CPR. The Village of Wellington Public Safety Committee and members of the public were introduced to the some of the department’s life saving tools, including the Lucas Device, King Vision Video Laryngoscope, and Electronic Patient Care Reporting (EPCR). The presentation provided the committee and members of the public with better understanding of department procedures during stressful cardiac arrest incidents.
