With SCOTUS’ refusal to hear any of the 10 pending cases relating to the 2nd Amendment, the Court has abrogated it’s responsibility to decide whether citizens have been denied their rights. The 2nd Amendment is nothing more than the red headed stepchild of the Bill of Rights. As Justice Clarence Thomas stated, the people would not tolerate if they had to provide a justifiable need to exercise their 1st Amendment rights to free speech or a woman’s right to abortion. Only when citizens desire to exercise their rights under the 2nd Amendment are these citizens have to jump through hoops that would not pass a strict scrutiny test. Here the Wall Street Journal does an excellent job of analyzing today’s decision by the US Supreme Court in New York State Rifle and Pistol Association v. New York City. The WSJ Editorial Board analogizes the right to obtain a permit for a gun to obtaining an abortion. It’s very good and on point. A Merry Christmas Story! I just received a favorable decision from the Office of Administrative Hearings on a denial on the issuance of a wear & carry permit. The client was the victim of a home invasion and the perpetrator is the son of the next door neighbor. The perp continued to threaten my client. Baltimore City PD would not arrest or take a report of the continued harassment. The client tried to get a peace order but it was never served so it was dismissed. MSP denied the application for lack of good and substantial reason to obtain the wear & carry permit. I argued the merits of the case to the Office of Administrative Hearings and presented evidence of the original incident as well as the continued threats. The judge ruled that my client had a palpable need for a wear and carry permit and reversed the MSP. A Merry Christmas for my client!
2021 MARYLAND LEGISLATIVE UPDATE – HB175 Delegate Shaneka Henson (D-30A) has pre-filed House Bill 175 (HB175) which will affect ammunition sales and transfers. One of the purposes of this bill is to require sellers of ammunition to confirm identity of purchasers of ammunition and to ensure that these purchasers are not prohibited individuals from owning or possessing firearms. This bill will require ammunition sellers to conduct a NICS background check as well as requiring the ammunition sellers to create an electronic record of the sale to include information such as the drivers’ license number, the brand, type and amount of ammunition sold, the purchasers’ residential address, date of birth and telephone number. This information which is to be obtained by the ammunition seller must be retained in an electronic database which is maintained by the Maryland State Police and will be fully accessible to law enforcement agencies. This bill may have the practical effect of ending online sales of ammunition and further restrict the sale of ammunition from out-of-state sellers. Lastly, as many shooting sport enthusiasts purchase large quantities of ammunition, will these purchases trigger visits from law enforcement or worse, such as an Extreme Risk Protective Order (Red Flag)? Hershon Legal will continue to monitor this legislation and will provide updates as they develop.
