In times of crisis, we should not "abandon the Constitution at the moment we need it most." So said Texas Supreme Justice John Devine, (quoting from the recent opinion in In re Salon a La Mode) in his concurring opinion, just released, in In re Hotze, criticizing Texas Governor Greg Abbot's unconstitutional "power grab" in light of the Covid-19 crisis. In Texas, we have checks and balances which prevent the Governor from unilaterally making or suspending laws. The Governor holds the power to convene a special session of the Legislature, but has chosen not to do so, instead taking the legislative power for himself. Although the majority opinion in In re Hotze dismissed the case on procedural basis, Justice Devine has clearly provided a warning to Gov. In the wake of the public outcry demanding accountability for Police Officers behaving badly in citizen encounters, our own local Police Department adds fuel to the fire. Six police officers, spent at least 33 minutes, arresting a homeless man for accepting a bottle of water from a kind soul on a West Lubbock streetcorner. In the process, the homeless man is dogpiled and punched at least three times, taken away in handcuffs, and his dog is sent to animal control. Is this really a wise use of our tax dollars? Six officers, six police vehicles, booking, time in jail, most likely a public defender, and the costs mount rapidly. In the extended video released by the City, you can hear one Corporal ask "Did he have warrants?" The arresting officer says "No, we just wanted to hit him with an instanter" (Meaning an arrest, rather than a paper citation). And the man's crime? Accepting a bottle of water from a car. This story comes to us from Colorado, where Allstate Insurance Company has low-balled their own customer's uninsured motorist claim to avoid paying her, even as she lays dying. I was honored to be asked to testify today before the Texas House of Representatives in support of Texas House Bill 88, the George Floyd Civil Rights Bill in Texas. This bill would create a pathway to justice for Texans who are injured or killed through police misconduct, would require new standards on use of chokeholds and other force options, and would require corroboration of undercover officer testimony.
