Covid is causing a lot of problems in the household. If the cops are called, someone is going to be arrested - even if the other party states they do not want to prosecute.

Every criminal defense lawyer needs to read the CCA decision in Watkins from March 3, 2021. It settled a long brewing controversy concerning whether "material to any matter involved in the action" in the Michael Morton Act (CCP 39.14) means simply relevant or whether it means, as prosecutors have argued, that the evidence sought would likely affect the outcome of guilt or innocence.
The CCA held (7-2) that it just means relevant and that it was error for the trial court to admit evidence not disclosed on request by the defense. Importantly, the CCA also held that "material to any matter involved in the action" was broader than just evidence showing guilt. In Watkins, the undisclosed material was just related to the State's proof of prior convictions and extraneous offenses at punishment. This is going to substantially increase the scope of what we ask for and what the State must turn over if they want to use the evidence at trial or otherwise. It also gives us a basis to require a judge to compel the State to turn over almost anything we seek so long as it is relevant.
