Can you imagine? Your 18-year-old son goes off to college, gets into a car accident, and is sent to the ER. When you call to find out if he's okay, the nurse tells you, "You do not have the right to speak to the doctor about your son's conditions."
This happens, and the nurse is correct: If you don't have the right documentation, and the child is unable to give authorization themselves, then you're not privy to your adult child's information.
You can avoid this situation by having your child fill out a HIPAA authorization, a medical power of attorney, and a statutory durable power of attorney.
To learn more about how to protect your adult children, give us a call at (281) 218-0880 or visit our website at HegwoodLaw.com!

One easy way to protect your children is by carrying an ID card in your wallet stating you have children at home, should something happen to you! You should also state who their guardians are and how to get in touch with them, so law enforcement officials will know who to talk to regarding your children.
For help protecting your family, be sure to call us at (281) 218-0880 or contact us here: https://hegwoodlaw.com/contact-us/

Would you be comfortable with your child receiving everything you left for them at the age of 18? Would they know how to manage this money all at once? To avoid a teenager squandering or mismanaging these funds, you can set up a trust, which is managed by a trustee of your choosing. You can choose to distribute certain funds or assets to your child upon them reaching a certain milestone, such as graduating college, purchasing a first home, or having a child.

One of the most important ways you can protect your family is by planning to avoid probate. Probate is not only expensive, time-consuming, and it may delay your kids’ access to your financial resources, but it is also PUBLIC. This means that anyone can see just how much your minor child will inherit when they turn the vulnerable age of 18. Fortunately, one way to avoid probate is by setting up a trust.

On October 23, 1981, the State Bar of Texas established the Paralegal Division of The State Bar of Texas. It became the first U.S. bar association to create its own division for paralegals. The Paralegal Division was established to promote high standards of conduct, professional ethics, and responsibility through continuing legal education (CLE). Next year will be the 40th anniversary!
In 2009, the Texas State Senate officially recognized October 23 as Texas Paralegal Day by adopting Proclamation No. 1144 to honor and recognize paralegals through their "exceptional talents and expertise, paralegals provide valuable services that contribute significantly to the efficient functioning of the judicial system in the Lone Star State and they are indeed worthy of special recognition."

Elvis Presley had an impressive estate tax bill - 73% of his $10 million estate went to the IRS after he died. That's about $7.3 million! That left his beneficiaries with around $3 million, but his manager turned that into only $1 million within two years. The probate court decided to investigate, and found that Elvis' manager had paid himself well in excess of normal fees. It wasn't until the manager was fired that the Presley Estate managed to build momentum and become the empire that it is today.
How would you feel if you had to pay 73% of your estate to the IRS? With an experienced estate planning attorney, you can prevent this from happening by minimizing or eliminating the taxes on your estate.

This is a great idea to allow your child to still feel your presence during important milestones, even if you are not there. Our final tip for reducing stress is to practice gratitude! Practicing gratitude helps you stay aware of life's simple pleasures - which you may currently take for granted or pay no attention to.
We recommend finding specific things to be grateful for. Instead of being grateful for your family, you could be grateful for the way your son laughs, your husband cooking dinner, or your daughter's caring personality.

What Will the Court Consider Before Granting Guardianship?
Clearly, the granting of a guardianship is a serious matter, since rights will be taken away from one person and given to another. The court must be convinced of:
• The extent of the ward’s incapacity
• The genuine need for guardianship proceedings
• The most appropriate person to be appointed guardian, taking into account “the best interest of the ward”
At Hegwood Law Group, we will guide you through the guardianship proceedings. We will make sure that you have the necessary detailed letter or certificate from a licensed physician to persuade the court of the need for guardianship. If you have decided that the guardian should be a compensated professional rather than a family member, we will see to it that the person chosen has the required certification (Certification Requirement for Private Professional Guardians and Public Guardians). https://hegwoodlaw.com/practice-areas/guardianships/

Houston Medicaid Planning Attorney – Today, the average lifespan for Americans has increased dramatically, due in large part to medical advances. Although this is a positive development, the challenges of aging — declining health, living on a fixed income, and paying for medical care, prescription medications, and assistive devices — are daunting. At some point, many elderly individuals may need to consider entering a nursing home or assisted living facility, the cost of which is exorbitant. Kathaleen is our Funding Coordinator, who works in tandem with our clients' financial professionals to ensure trusts are properly funded! Her role is a part of what sets our firm apart from the others, as it is common for other estate planning law firms to leave it to their clients to fund their own trusts, resulting in many trusts remaining unfunded.
Kathaleen discovered her interest in the legal field while serving on a grand jury in Galveston County almost 10 years ago. She has over 7 years of paralegal experience focusing on civil litigation. She is perfectly suited for paralegal work due to her attention to detail and multitasking abilities, and derives great satisfaction from a job well done. She grew up in Dickinson, TX and enjoys lifting heavy things at the gym, cheat meals, knitting/crocheting, cross stitching, completing DIY house projects, and adopting old dogs that no one else wants.

When someone has dementia, keeping them engaged is more important than ever. Kim Hegwood's guest today, Robyn Horn has some really great ideas and tips on how to do that. Kim and Robyn will discuss:
1. Why is it important to develop a daily activity plan for a PWD (Person With Dementia) (activities are "things we do" including taking a bath, playing games, etc.)?
2. What should the caregiver keep in mind when developing that plan (ie. person, activity itself, approach, place)?
3. What are some strategies in communicating with the PWD throughout the day/daily plan?
4. How does a caregiver learn to anticipate/learn the triggers to avoid common behavior problems?
5. What are some activities that a caregiver can incorporate into the daily plan?
6. How does the caregiver assess and make changes to the daily plan as needed?
Aging does not have to be difficult! Having a successful estate plan or long-term care plan in place can help you navigate through the challenges. Download our free Elder Law Checklist to learn more about these helpful documents!
