SPEEDING TICKETS Under NRS 484B.600, it is a misdemeanor in Nevada to drive faster than the posted speed limit. But it may be possible to fight speeding allegations and win. Five potential defenses are: 1. The police made a mistake. Perhaps their radar gun malfunctioned, or perhaps the police pulled over the wrong vehicle. 2. There was an emergency that justified speeding, such as being chased by a deranged driver. 3. The driver was falsely accused. Perhaps the police issued a bogus citation to meet a quota. 4. The driver had a medical episode and lost control, such as during a diabetic seizure. Or 5. The car malfunctioned and accelerated at no fault of the driver. A defense attorney would search for all available evidence, including surveillance video, eyewitnesses, police records, medical records, and vehicle maintenance records. If prosecutors see that their case is too weak to sustain a conviction, the charge should be dropped. Alternatively, prosecutors may agree to reduce speeding charges down to a non-moving violation. DRIVING WITH NO CAR SEAT Under NRS 484B.157, Nevada drivers are required to use a child restraining system such as a car seat when transporting a child who is under 6 years old and 60 pounds or less. The car seat must have been approved by the U.S. Department of Transportation. Transporting a child without the appropriate car seat is a misdemeanor. A first-time offense carries $100 to $500 in fines or 10 to 50 hours of community service. However, the court will waive these penalties if the defendant completes a child restraint system training class within 60 days of the sentencing. There are exceptions to this car seat rule. For instance, car seats are not required on public transportation, such as taxis, school buses, or emergency vehicles. And car seats are not legally required when a doctor believes it would be impractical or dangerous for a particular child due to a physical or medical condition. PARKING IN A HANDICAP SPACE Under NRS 484B.467, handicapped parking spaces are reserved for vehicles with a current and valid handicap license plate, placard, or sticker. Otherwise, drivers risk having their vehicles towed and impounded. These impound lots charge a daily storage fee, and they may auction off vehicles that do not get picked up. Wrongfully parking in a handicapped spot is a misdemeanor, usually carrying a $250 fine. In the city of Las Vegas, wrongfully parking in a handicap spot is treated as a civil infraction rather than a crime. But if the defendant fails to pay the fine after 90 days, the DMV will suspend the driver’s registration. In any case, it may be possible to get a charge for illegally parking in a handicapped spot dismissed on either of the following three grounds: 1) The parking spot lacked the required handicapped signage. 2) The defendant had the proper plates or tags, and the police officer just did not see them.
