CHAPTER 7 BANKRUPTCY
A chapter 7 bankruptcy is also known as a debt liquidation because It wipes out most unsecured debt including credit card debt. In a Chapter 7 bankruptcy, an appointed trustee can collect the assets of a debtor in order to reduce them to cash to pay creditors. However, many Chapter 7 debtors usually qualify for exemptions that alleviate the need to turn over actual assets; these are “no-asset cases.” A debtor with assets that they wish to keep and not covered by the chapter 7 exemptions usually file Chapter 13 bankruptcy.
CHAPTER 13 BANKRUPTCY
A chapter 13 bankruptcy is also known as a debt repayment plan. Unlike the chapter 7 bankruptcy which is used to wipe out debt, the chapter 13 bankruptcy debtor makes payments to a bankruptcy trustee over a period of three to five years in order to catch up or “cure” delinquent payments to secured creditors. After the plan is successfully completed, all unsecured debts are discharged.
A chapter 13 bankruptcy debtor is required to have a regular source of income in order to make the monthly payments to the trustee.
