An article recently appeared which underscores how an electronic footprint does not disappear and can lead to untoward results. In this case, a woman had posted on a dating website dedicated to married individuals who wanted to cheat on their spouse. Predictably, the spouse discovered the post and filed for divorce. Posting on website even under a false name can create significant future problems.
In most cases the Courts will not order the sale of the marital residence prior to the final hearing. A recent Eighth District case, however, outlines a scenario where the Court of Appeals upheld the authority of the trial court to order the sale of the marital residence while the divorce was still pending finding that it was not an abuse of discretion. The trial court had found that the parties could not afford to maintain the home . Other relevant factors raised by the party requesting the sale were that the trial had been delayed and that the opposing party had initially failed to oppose the motion. It is important to note that in the event a trial court does order the sale of the property while the divorce is still pending that this is an appealable order. Malik v. Malik , 2018-Ohio-4901.
