Yesterday, I filed a Collective Action lawsuit against a local well-known establishment, Campo Verde Mexican & American Cuisine restaurant, in Arlington, Texas. The lawsuit was filed on behalf of all similarly situated employees that may have worked there for the past 3 years.
Allegedly, Campo Verde has failed to pay its employees overtime wages in accordance with the Fair Labor Standards Act. In retaliation, Campo Verde fired two employees, the lead plaintiffs, after they complained of not being paid overtime wages.
These allegations are simultaneously being investigated by the U.S. Department of Labor - Wage & Hour Division.
A Collective Action is similar to a Class Action suit, but derived by statute under the FLSA....

Legal Tip Thursday: You must have a strategy and an end game in litigation. If not, you will likely fail or use unnecessary resources on your quest for "justice" (whatever that may mean to you). This may cause your client to incur more costs. Work the case from back to front. In other words, read and prepare your jury charge prior to filing a lawsuit. Knowing what you have to prove to a jury will help you to strategically and effectively develop your evidence to prove the legal elements of your claim (s).
