Regarding the injunction against the increase of USCIS filing fees, I want to share this blurb from the Director of the New England Chapter of AILA. It gives the same non-answer I have been giving people, but it does a more thorough and thus better job of it: "As you know, on September 29, 2020, a district court stayed the implementation and the effective date of the August 2020 Final Rule, which changed the fee schedule and required new versions of several forms, in its entirety pending final adjudication of this matter. (ILRC et al., v. Wolf, et al., 9/29/20). Bravo to AILA National for this victory. As of September 30, 2020, many members are wondering how long the injunction will remain in effect. Unfortunately, it is impossible to say with any certainty how long the rule will remain enjoined. The government has up to 60 days to appeal the decision. As the decision rests on significant part on the authority of Chad Wolf, we may gain insight by looking at the government's handling of Casa de Maryland, Inc. v. Wolf which also found his appointment unlawful on September 11, 2020. To date, the government has not filed an appeal in that case. Another factor to consider is that the District Court of D.C. is also reviewing a challenge to the fee rule in Northwest Immigrants Rights Project v. USCIS; however, there has not yet been a ruling in that case."

The IRS is still horrifically behind in opening its mail, but is resuming sending past due notices any way. This means that a large number of people who have mailed checks to the IRS will nevertheless receive notices saying that they have not paid. Worse, since the problem is that the IRS has not opened the envelope that the check came in, calling the IRS will not help. They will simply reply that they have no record of receiving the check. “In light of the fact that the motion filed by Granados Benitez is a motion to reopen and seek a continuance from the IJ, we conclude the Board abused its discretion. It abused its discretion by failing to conduct a proper analysis, failing to consider its own policies and precedents, and ignoring the position of its sister agency, ICE. The Board did not analyze whether Granados Benitez made out a prima facie case for a continuance under the appropriate standard. “The current standard set by the Board for a continuance in light of a U visa application is well settled. On remand from the Ninth Circuit, the Board in Matter of Sanchez Sosa, 25 I. & N. Dec. 807 (B.I.A. 2012), set out the three factors IJs should consider in ruling on such a motion. … “Decisions from other circuits further support our view that the Board must follow the Sanchez Sosa framework, or explain its reasons for applying a different standard. This court has not previously considered the issue. But the Seventh Circuit found the Board abused its discretion by denying a motion to remand removal proceedings to the IJ for consideration of a motion to continue in light of a U visa application because the court found the Board’s analysis of the Sanchez Sosa factors too cursory. … “The Board itself has also found that a U visa waitlist determination warranted reopening and remand, using the Sanchez Sosa standard, in at least two unpublished decisions. … “We conclude that Sanchez Sosa remains the applicable standard for considering whether a continuance is likely to be available. In this case, the Board did not even cite to that standard. Rather, it mischaracterized Granados Benitez’s request as a motion to reopen and terminate proceedings, and denied his application under the standard for that different motion."
