Presutti, P.C. | September 2020 | Car Accidents Communities often install traffic signals at busy intersections to help improve traffic flow and enhance safety, but you face certain risks when navigating these areas. Research shows that your chance of getting into a crash with a red-light runner is particularly high in Texas, with the state seeing the sixth-highest number of red-light fatalities in the nation. According to the Corsicana Daily Sun, motorists who ran red lights were responsible for 971 Texas traffic fatalities between 2008 and 2017. The number of people suffering injuries because of drivers running red lights is also on the rise. Common victims In many fatal car wrecks that take place in signaled intersections, it is not the red-light runner who dies. Research shows that while the negligent driver dies in about 35% of fatal car crashes caused by red-light runners, it is passengers or drivers in other vehicles who lose their lives the majority, or 46%, of the time. You also face injury and fatality risks when navigating a signaled intersection on a bicycle or on foot. Studies show that more than 5% of those killed in such crashes are either pedestrians or cyclists. Safety measures You face a higher risk of involvement in a crash caused by a red-light runner when you live in Texas, as opposed to most other states, but there are several ways to enhance personal safety. Tap your brake a few times when you approach a red light to make yourself more noticeable to those behind you. Also, practice defensive driving by waiting a brief moment after the light turns green before making your way through the intersection.

When you read news stories about driving trends these days, you are more likely to hear about distracted or drunk driving than road rage. But that does not mean that road rage crashes aren’t still a big problem in Houston. Maybe you have been targeted by an out-of-control driver trying to injure you (or at least scare you) for something “wrong” you supposedly did. You can’t predict if a road-rage driver will ever force you into a car crash, but you can take steps to reduce your risk. Here are four tips for preventing road rage: 1. Give yourself plenty of time. Try to leave early enough so that you can reach your destination without having to rush. This makes it unnecessary to speed, tailgate or change lanes frequently, any of which can anger a potential road rager. 2. Do the zipper merge. Ideally, everyone would let other vehicles merge in front of them one at a time. This is called “zipper merging.” Set a good example for others by giving space to the person ahead of you in the merge lane to get over. 3. Ignore jerks. It can be tough in the heat of the moment when someone cuts you off or makes an obscene gesture at you. But try not to escalate the situation. Avoid making eye contact or responding. 4. Drive to the police. If a road rage driver starts following you, proceed to the nearest police station or sheriff’s office. Stay in your car until you get there. If you think you are in immediate danger, call 911 and let them know what is happening. Hopefully, the sight of the station will convince the road rager to leave you alone instead of committing a crime in front of dozens of officers. We all have to deal with rude drivers from time to time. Hopefully you will never get in the way of a driver consumed with road rage who gets you into a serious accident. Traffic laws for bicyclists Much like any other vehicle on the road, bicyclists must honor prevailing traffic laws and rules. Without comprehensive auto insurance, however, the driver who caused the accident may not have the financial means to provide you with an adequate amount of relief. As noted by the Texas Department of Insurance, your personal auto insurance policy may cover your medical expenses, property damage and vehicle repairs when an uninsured driver caused the accident. Provided that your policy includes uninsured and under-insured motorist coverage, you may file a claim with your own insurance carrier. What if an uninsured commercial truck driver causes an accident? Accidents involving an uninsured or under-insured truck driver may require a legal action when he or she acted as an independent contractor for a freight broker. For example, a Lone Star State commercial freight broker that hired an independent contractor to haul goods may not know that the driver lacked the insurance coverage required by law. Car Insurance Claims: What NOT to Do • Don't give any recorded or written statements to your insurer until you are sure you understand your coverage. Remember you aren't required to allow the insurance company to record your telephone conversation. • Don't automatically accept the estimate or appraisal of your losses given to you by the insurer. Insurance companies will often try to get you to accept their estimator's or contractor's repair or replacement estimates, which might be a bit low. Don't accept any check that says "final payment" unless you are ready to do so. • Don't ignore time limits set by your policy. Most policies require a signed proof of loss within a certain time limit. Be sure you comply with this requirement unless you obtain a written waiver from your insurance company. Your insurer has a legal obligation to provide the coverage. Don't sign any releases or waivers of any kind until you obtain legal advice. A bad financial situation after a major loss may make it seem necessary for you to accept a premature, inadequate settlement from your insurer. But you may remember destroyed items after you have signed a release as to payment for your personal property inventory or other claims. For these reasons, it is advisable to consult an attorney before signing a release or waiver. Be sure to read the fine print on any payment from the insurance company.

When there are many cars on the road at the same time, there is a greater chance for an accident or even a catastrophic pile up if one driver is not careful. If you routinely drive in heavy traffic, below we have six key safety tips to keep in mind: Watch your speed – Speed is constantly one of the main contributing factors to accidents. In heavy traffic, you may want to speed to a lane opening or quickly change lanes. These quick movements can easily cut someone off and cause trouble. Refrain from weaving – Weaving around traffic hardly gets you to your destination fast enough to justify the danger you are putting yourself through. The other problem is other drivers are not aware of your erratic driving patterns, so even though you know what you are doing, others don’t. Know the conditions – Sometimes you can predict large traffic build-ups and prepare for it. Is there inclement weather? A sporting event or festival everyone is going to? Many miles of road construction? If you know traffic will be heavy, leave early and pack plenty of patience. Keep your distance – All drivers wants to keep moving forward, but recognize when you should hit the brakes instead of the accelerator. It is important to always check for brake lights ahead of you, and keep your distance if you see someone slow down or stop. Always stay at least three seconds behind the driver in front of you. Expect the unexpected – As mentioned above, you do not want to speed or weave in and out of traffic because you do not know what is coming up. Constantly survey the road ahead of you so you are aware of everything going on. Try to relax – Even if the speed of the heavy traffic is going faster than you would like, do your best to relax. Move over to the farthest right lane and go a speed you are more comfortable with. If you start to get aggravated, try turning on the radio.
