I definitely feel more confident in the Michigan State Police breath testing program now, given their frankness, openness, and transparency.
VICTORY in 14B District Court -- .19 Blood draw accident involving underage motorist with CDL. I saved his CDL with a NOT GUILTY verdict across the board. Not guilty on Super Drunk, not guilty on OWI, and not guilty on impaired. Prosecutor was unreasonable and forced this young man to go to trial, and we won. Thank God, and thank you to my jurors, the judge, and the police officers, who were all awesome! Special thanks to Lansing attorney Michael Nichols who gave me the internal emails from MSP toxicology labs that turned this whole case around.

Reciting the ABCs is not a standardized test, and under MCL 257.625s, the prosecutor must introduce evidence to establish that a non-standardized field sobriety test qualifies for admissibility under the Michigan Rules of Evidence.

I won a big Datamaster case this afternoon regarding the Michigan breath testing crisis. I don't have the ability to download it, so here it is for a limited time. It starts near the end of the recording at around 56:08.
