Dealing with an employer after a work related injury is always a sensitive issue, especially when the employer is a small business with handful of employees. This goal is beneficial to both parties because with proper and timely treatment injured worker can recovery quickly and return to his work without affecting the employer's business. Unfortunately, sometimes this isn't the goal of the workers' compensation insurance companies. To make matters worse for the injured worker and the employer, many workers' compensation insurance companies delay accepting the claim under the pretense of investigation causing friction between the injured worker and the employer. The employer wants the injured worker coming back to work as soon as possible, but injured worker isn't able to return to work because he has not received any meaningful treatment to get better. One of the most frustrating part of my work is dealing with delay of treatment under the disguise of “proper procedure” by work comp carrier. Timely treatment in work injury case seems almost impossible. There has to be a better way to provide treatment for injured workers. Delayed treatment is same as no treatment in most cases and lots of injured workers who could have recovered quickly with timely treatment are suffering long term consequences because of delayed treatment. Work comp carrier’s strategy is to prolong the pain and suffering and make the injured workers give up on their right to their benefits. I want to encourage the injured workers to stay focus and continue on with your case. Do not give up because that’s exactly what they want you to do.
