Mediation is a formal process designed and intended to resolve disputed issues in the divorce proceeding. The attorney mediator does not represent either of the spouses, but acts as a neutral and is highly trained and experienced in facilitating settlement agreements and a memorandum of understanding (“MOU”). The MOU can be used to prepare documents to file with the court that will finalize your divorce.
Mediation may not be needed as to all parts of the divorce. If you and your spouse are in agreement on most issues, it may be only child custody, or property, or certain assets that are at issue as community property. Mediation can help define the landscape of the problem and get to an agreement to get matters done.
