If you would like to hear what a true American leader sounds like, listen to any of the speeches by Rev. Dr. Martin Luther King, Jr. Whether he is speaking to an auditorium of junior high school students in Philadelphia or standing on the steps of the Lincoln Memorial before 250,000 people, he delivers a message of hope. It is shameful that we have failed to overcome racial and economic prejudice. Today is a good day for the America that we have become to take the time to think deeply, reflect on the recent past, and promise to ourselves and our children and our grandchildren, to do better.
I’m outraged – and you should be too. In the busiest time of year for estate planning attorneys, bankers, business owners and financial services, the IRS began a planned outage from December 23, 2020 – January 4, 2021. If you need to have an EIN issued for a client or business that establishes a legal entity by December 31, 2020 – too bad. The IRS is making sure that you are stymied – and there’s no workaround. It’s maintenance – at the worst possible time. If you’ve got a workaround, I’d love to hear it.

After over five years of negotiation between the New York State Bar Association, the legislature passed, and Gov. Cuomo signed a law significantly changing New York State's Power of Attorney form (" POA"). The new law simplifies and improves the POA form and its use for families and individuals.
Here are some of the changes:
Refusal of a valid POA exposes the bank or other third party to sanctions, legal fees, and damages that result from the refusal to honor a properly executed POA.
Language in the POA form must "substantially" confirm to the statute.
The new law eliminates the Statutory Gift Rider.
Eliminating the Statutory Gifts Rider also removes the need for witnesses. The signature of the person granting the POA only needs notarization. Find witnesses was difficult during this pandemic.
