I was watching this television show on Netflix called, "Breaking Bad." There is an Attorney character on the show, called Saul Goodman, who is flashy, loud, criminal defense Attorney. I have seen Attorneys like that in the bigger cities like Houston. You will not usually find them in cities the size of Corpus Christi, or smaller. One thing the character stated that was interesting, and true, was, when he stated "You want a Criminal Attorney" versus a "You want a Criminal, Attorney." The distinction being, that there are certain criminal lawyers who are also criminals. For example, the "criminal Attorney" may take payments in drugs. Some do drugs with their clients. Some are a member of the organized crime groups they represent. Some may do criminal acts in defense of their clients; however, I believe that is extremely rare. Pretty much, even when I was younger, I Iet my Criminal clients know that I was sitting on one side of the desk and they were on the other. I liked many of the criminal clients, but I was not going to be partying with them, or associating with them generally. I keep this distance not only for my protection, but for my clients protection as well. Representing people is not fun, or a drug escapade or company; it is work.

You are not entitled to see the evidence aginst you generally for a felony, until you are charged for the crime by an indictment. You are not entitled to it merely because you have been arrested.

Had someone who called me this week regarding a felony Motion to Revoke Probation. The bad news was that he was on straight probation, so when he is arrested or turns himself in he will have to wait in jail until he goes to court for his hearing. You are not entitled to a bond if you are on "straight probation". You are entitled to a bond if you are on "deferred adjudication probation." The good news is that he was on "straight probation." Therefore, say he he is on third degree felony probation and is 5 for 5, that is 5 years probation, 5 years in prison if he violates. The most the Judge can sentence him is to five years in prison. If he were on "deferred adjudication probation" then the judge can legally sentence him from 2 to 10 years, that is the Judge can give him the maximum of 10 years in prison. So whether you are on "straight probation" or "deferred adjudication" probation is very important regarding a motion to revoke.

A prospective client called me from another state this week and said he went to buy a rifle in February and was told that he could not buy it because he had a warrant for his arrest in Nueces County for a misdemeanor. I looked up his case online and told him it appeared that his warrant was lifted by the Judge in June, so it appears that he could buy the rifle now. I told him that is what I could tell him based upon the public records, although they are not guaranteed to be accurate. I told him he could check it online himself if he wants. I said that if he wanted me to look into the warrant further he'd have to hire me for the misdemeanor case. He said he would call me in two weeks after he raised the money for representation.

People state to me they do not want a pending criminal case on their "record". I begin the discussion by telling them that there are various record keeping agencies and data bases, and that there is a record of "arrest" and a record of "conviction". I then explain even if their case is dismissed today that they will have a record of "arrest" the rest of their lives, unless they file a petition for "expungement" in court.

Many of my clients who are released on bond, who are charged with assaulting their children or spouse, are as a condition of their bond, not supposed to return to their homes. The Judge might reconsider that condition if the Defendant is on bond for a lengthy period of time. However, the Lawyer has to draft a motion, and file the motion, and attend a hearing to have this condition modified. Unfortunately, when you hire a lawyer, they do not know if the situation will arise to modify the conditions, so they do not quote the fees for a modification of the conditions. Generally drafting a simple motion in court and attending a court hearing will take no less than two hour of an Attorneys time. 🤖
Interesting. If you are on deferred adjudication, Community Supervision, that is also called Probation, there is no minimum amount of time you need to serve in order to file a Motion to reduce or terminate your Community Supervision! So in theory, you can file a Motion to terminate and to reduce your community dupervision the day after you are placed on it; assuming you were given deferred adjudication.
I have had many clients who have told the feds when caught or stopped that they knew they were carrying illegal drugs, but did not know what the illegal drugs were, or assummed it was marijuana. I do not know what they are thinking, but the are still responsible for the cocaine, or whatever, the serious drug is. Not knowing what the drug is will not result in an acquittal or not guilty finding.
One of my guys came in the office a while ago and said a blanket over the electronic monitor on his ankle will interfere with the telephone signal; and, give out the alarm that he is not at home during his curfew. So he slept with his leg sticking out from under the blanket.

The drunken man would not settle down when an exasperated Henry Plummer leaped up from a table and said, “I am tired of this!” and pulling his pistol shot Cleveland twice. Falling to his knees while wildly grasping for his pistol he appealed to Plummer not to shoot him while he was down. As he staggered to his feet Plummer shot him two more times. Plummer then calmly left the saloon. Cleveland was a coarse, foul mouthed, bully who it was believed had murdered a miner a few weeks earlier. His death caused little concern among the citizens of Bannack. Plummer was later tried before a Miner’s Court and “honorably acquitted.” The Goodrich Hotel. TL
My experience has been that you are kept in the Nueces County Jail Annex, instead of the Downtown Jail because you are on Parole, and are awaiting a hearing, or because you are pending a Motion to Revoke your Probation.
