Fellow Oregonians - there is a crucial vote coming up this week about a bill to eliminate the cap of $500,000 in non-economic damages in personal injury claims. The bill restores our constitutional right to let a jury of our peers decide what is fair and just. Call your state Senator and ask them to vote “Yes” on Senate Bill 737. Last year, the Oregon Supreme Court in the Horton case reversed a decision it had made 17 year earlier, and reinstated an arbitrary cap on monetary damages injury and abuse victims can seek from their wrongdoers. Senate Bill 737 would eliminate the cap and restore the decision to decide monetary damages to juries based on the particular facts of each case. The reality is that this law will not impact most people. However, for victims of horrific sexual abuse, irreversible medical errors and catastrophic personal injuries, their lives are irreparably changed.
