Today, the Tennessee Court of Appeals, sitting at Nashville, will hear the appeal in Cartwright v. Tennessee Farmers Mutual Insurance Company. Our founder, Arthur E. McClellan, is lead counsel for the appellee, Tennessee Farmers, with our associate Elizabeth R. McClellan sitting second chair in her first appearance before the Court of Appeals. As we mentioned last week, Cartwright is likely to reach an issue of first impression regarding the intersection between Tenn. Code Ann. 1-3-102 governing the timing of all legally required acts and the Tennessee Rules of Civil Procedure governing time for filing and notice of motions and other papers. We will update you regarding the appeal when the slip opinion is available.
Our founder, Arthur E. McClellan, will appear in the Tennessee Court of Appeals for the Middle District of Tennessee on June 5, 2014 representing the appellee in the case of Cartwright v. Tennessee Farmers Mutual Insurance Company. Firm associate Elizabeth R. McClellan will sit as second chair on appeal. The issue on appeal centers in part around the intersection between the Tennessee Code governing time for performance of legally required acts and the Tennessee Rules of Civil Procedure governing timing and notice of civil filings. This issue of first impression has the potential to create a new understanding of the relationship between Tennessee state law and rules of civil procedure which dictate the timing of filings and other legally required acts including service of process.
