IMPORTANT CHANGES IN YOUR LEGAL RIGHTS: THE POLICE MAY NO LONGER SEARCH YOUR CAR WITHOUT PROBABLE CAUSE AND EXIGENT CIRCUMSTANCES. HERE’S WHY: The Pennsylvania Supreme Court ruled on December 22, 2020 that the police will now need to have BOTH probable cause AND the presence of exigent circumstances to search your vehicle without a warrant. For many years now, courts in Pennsylvania have allowed the search of a vehicle without a warrant based on probable cause alone. For example, the police could search your vehicle without a warrant (minus the trunk) if they had something as simple as the odor of marijuana. Again, your consent or non-consent to the search didn’t matter. No longer! With this ruling, officers now must ALSO have exigent circumstances present if you do not consent to the search. Exigent circumstances is a legal term that simply means there is no time for an officer to wait and get a search warrant. That requirement is now an additional factor the police must have and will be based on the facts of each case.
