In 2016, a jury found a man guilty of manslaughter and three counts of assault. He was sentenced to 17 years in prison.
Tory Bernsen, one of our partners, was asked to evaluate the case post conviction. Ms. Bernsen uncovered multiple Brady violations, deliberate unethical actions taken by the State to obtain a conviction at whatever cost, and serious cover-up by civil servants, politicians, and the court.
After nearly two years of litigation, Ms. Bernsen walked our client out of prison. He had served 3 years of his 17 year sentence. It was our privilege and honor to right this wrong.
It is a terrifying tragedy that our judicial system can be so broken. The cover-up still exists and persists - the assistant prosecuting attorney (a career prosecutor who has a record of such conduct) was required to attend a seminar on timely disclosure of evidence to criminal defendants. Thats all. He’s still prosecuting criminal defendants just as before. We must not allow ourselves to become complacent, we must fight the hard fights.
