Hundreds of veterans are filing lawsuits against a government contractor that manufactured and sold defective combat earplugs to the military.
The earplugs did not maintain a tight seal and allowed dangerously loud sounds to slip through without the wearer knowing. In lawsuits filed, it was alleged the Minnesota-based 3M Company designed the earplugs in a defective manner and failed to warn users of the defect. As a result of the defective product, service members reported hearing loss, tinnitus and loss of balance specifically by those who used 3M’s trademarked, dual-ended Combat Arms earplugs during their military service between 2003 and 2015. The pharmaceutical companies behind the widely advertised blood thinner Xarelto reached a $775 million-dollar settlement in 25,000 lawsuits alleging patients were not adequately warned about the risks of life-threatening complications.
Xarelto is the brand name for the drug rivaroxaban. Among its uses is treatment and prevention of blood clots in the leg or lung and prevention of strokes in people with irregular heartbeats. Heavily advertised on television, it was hawked in a widely seen 2015 ad featuring comedian Kevin Nealon, golfer Arnold Palmer and NASCAR driver Brian Vickers.
Lawsuits dating back to 2014 had been consolidated in federal court in New Orleans. They involved claims that users of the medication marketed by Bayer Healthcare and Janssen pharmaceuticals were not adequately informed of risks of life-threatening complications including internal bleeding, strokes and deaths.

JUUL CEO, Kevin Burns, recently admitted that his company is “partly responsible” for the epidemic of youth vaping in the U.S. He also recently received the following letter from the FDA regarding JUUL marketing to kids:
"The July 24-25, 2019 House Subcommittee hearing included the following evidence:
• A JUUL representative speaking with students at his presentation stated that JUUL “was much safer than cigarettes” and that “FDA would approve it any day.”
• The JUUL representative speaking with students at his presentation called JUUL “totally safe.”
• The JUUL representative speaking with students at his presentation stated that a student “…should mention JUUL to his [nicotine-addicted] friend…because that’s a safer alternative than smoking cigarettes, and it would be better for the kid to use.”
• The JUUL representative speaking with students at his presentation stated, “FDA was about to come out and say it [JUUL] was 99% safer than cigarettes…and that…would happen very soon….”
Referring to your Electronic Nicotine Delivery System (ENDS) products as “99% safer” than cigarettes, “much safer” than cigarettes, “totally safe,” and “a safer alternative than smoking cigarettes” is particularly concerning because these statements were made directly to children in school.
Our concern is amplified by the epidemic rate of increase in youth use of ENDS products, including JUUL’s products, and evidence that ENDS products contribute to youth use of, and addiction to, nicotine, to which youth are especially vulnerable.”
The FDA, under former Commissioner Scott Gottlieb, has repeatedly aired concerns that e-cigarette flavors such as Mango, Fruit, Cucumber, Mint, and others that JUUL has used, are particularly attractive to youth.
Desmond Jensen of Hamline University School of Law's Public Health Law Center stated, "We have millions, literally millions, of kids under the age of 18 who are now using tobacco products, and they would have never, absolutely never, touched those products but for the existence of Juul."
