August 2016 – Hingham District Court – The officer reported that after being dispatched to the report of a motor vehicle accident involving a pedestrian, he spoke with the pedestrian who said the client had hit him from behind as he was walking and he was tossed into the air, hit his head on the client’s windshield and his boots came flying off. The officer further reported that the pedestrian told him the client’s front license plate came off during the incident and he held onto it . The officer stated the pedestrian asked the client for a ride to his house and when they arrived arrived, the home owner, not knowing the client, did not let him in so the client left. The officer further stated he checked the license plate, went to the registered owner’s home and saw a car in the driveway with a shattered windshield and a hood that was warm to the touch. The officer reported that upon knocking, the front door was answered by the client who immediately smelled strongly of alcohol, had slurred speech, was unsteady on his feet, had glassy and bloodshot eyes, and admitted drinking as well as being the operator of the car that struck the pedestrian. The officer further reported that after agreeing to do field sobriety tests, he failed the walk and turn and one leg stand field sobriety tests. – CASE DISMISSED
August 2016 – Quincy District Court – The officer reported that after he received a report of an erratic driver, a second officer advised that he had stopped the client after seeing him have trouble staying in the right travel lane. The officer stated that upon arriving on scene, he noticed the client had glassy and bloodshot eyes, smelled strongly of alcohol, and failed the one leg stand and walk and turn field sobriety tests. – CASE DISMISSED
July 2016 – Plymouth District Court – The officer testified he sat behind the client’s car at a stop sign for approximately 15 seconds with no sign of other traffic and thus sounded his air horn to get the client’s attention. The officer stated the client proceeded toward a red light, and again, the client remained stopped after the light turned green, so the officer again sounded his air horn. The officer further stated he could see the client in the client’s side view mirror and it appeared as thought the client could not keep his eyes open. The officer stated he stopped the client after the client weaved drastically from the centerline to the fog line and that, on approach, there was a strong odor of alcohol coming from the car, noticed the client had glassy, red and bloodshot eyes, had difficulty keeping his eyes open, had thick-tongued speech, did not produce his license and registration and looked like he was going to fall asleep. The officer lastly stated that after being placed into custody, the client had difficulty walking and nearly stumbled into the rear of his truck. – NOT GUILTY
June 2016 – Waltham District Court – The officer testified that after responding to the report of an accident, he saw that the client’s car had crashed into two parked cars and the client was in the process of getting out of her car. The officer stated the client was very apologetic, smelled like alcohol, had bloodshot and glassy eyes and at times slightly slurred speech and was having a very hard time focusing on the conversation. The officer further stated the client admitted having three beers, could not say the alphabet as instructed and failed the walk and turn and one leg stand field sobriety tests. – NOT GUILTY
June 2016 – Lynn District Court – The officer reported the client was stopped at an intersection and when he decided to pass it, noticed the client unconscious and passed out at the wheel with the engine running and on approach noticed the window completely down. The officer stated he tried waking the client, which did not work, so he tried shining his flashlight toward the client’s face, which woke him up. The officer further stated it was at this time he smelled a strong odor of alcohol coming from the client and asked the client if he had any alcohol to drink recently which the client stated he did: “a few drinks like three hours ago.” The officer reported the client had bloodshot eye that were glassed over, slurred speech and was unsteady on his feet and stumbling while getting out of his car. The officer further reported the client failed the walk and turn and one leg stand field sobriety tests. – CASE DISMISSED
June 2016 – Wareham District Court – The officer testified that he stopped the client for tailgating, abruptly swerving around the vehicle it was tailgating to pass, at which point he passed several vehicles, speeding up to 80 mph at times and swerving from the travel lane into the breakdown lane multiple times. The officer stated the client did not immediately stop and when he did, the officer stated he smelled both a strong odor of alcohol and a strong odor of freshly burnt marijuana coming from the client’s car. The officer further stated the client admitted having one drink and smoking marijuana “two hours ago” which he revised to thirty minutes ago when advised of the intense odor. The officer testified the client’s eyes were bloodshot and glassy, that he had slurred speech and could not complete the one leg stand field sobriety test. – OUI 2nd OFFENSE, NOT GUILTY
