Yesterday our law office received word that another client of ours was awarded their SSI benefits following a hearing last month.
Eric Conn state court class action hearing scheduled for August 7th at 10:15 in Floyd Circuit Court.
We ended up with about $24,000 in left over funds. The Judge had originally ordered that the left over monies be distributed to legal aid organizations and the local food banks.
Our office has received claims from about 20 former Conn clients after the deadline. When I notified the Special Master of the late claims- he advised me to file a motion with the Judge.
It will be up to the Judge to determine how the remaining funds are distributed.

Lawsuit filed to stop dissolution of circuit court in Floyd County
Good news from the Kentucky Court of Appeals today. Our client Breathitt Countian Harold Smith has been sitting in jail for two and half years for two marijuana convictions out of Livingston County.
Today the Court of Appeals reversed one of his two convictions, reducing his sentence from fifteen years to five years. His co-defendant who was represented by Janet Stumbo had his marijuana conviction reversed.
Could not understand that when Matt Bevin was pardoning people for cutting the heads off of live human beings, why Harold was sitting in jail for cutting the heads off of marijuana stalks.
Eric Conn fiasco update- great news today from the Fourth Circuit Court of appeals.
They upheld the opinion we won in South Carolina for Gary Kirk.
The significance is that the SSA losing streak challenging the ruling by the Sixth Circuit in the Hicks case declaring their mass hearings unconstitutional continues.
They have not lost consecutively in the Sixth Circuit, Seventh Circuit, and today in the Fourth Circuit, not to mention about ten US District courts, in their endless appeals.
Their losing streak combined with a change in personnel within the SSA, causes me to be more optimistic that we can finally end this six year old horror show for our vulnerable friends and neighbors.
I am especially happy for my friend and client Gary Kirk who trusted me to go to South Carolina and argue and win his case. Also thankful for the wonderful lawyers at Wilmer Hale who did great work at the appellate level.
Just called Gary and told him the news that not only helps him, but hopefully the other thousands of former Conn clients who are still frightened.

Eric Conn fiasco update- CNBC is repeating their episode on the Eric Conn debacle. They did two shows. The second show originally aired in 2020.
It featured Clinton Mullins and included an update which described the string of legal victories that Clinton and about 220 former clients achieved and had their benefits reinstated after multiple federal courts ruled their benefits were taken away due to unconstitutional hearings.
Unfortunately since that time the SSA has notified Clinton and the others they will put them through another round of mass hearing strictly focused on whether they were disabled about 12-15 years ago.
Hopefully the recent personnel changes within the SSA initiated due to a new administration will stop this assault on our vulnerable friends and neighbors.
