As to the TPC explosion, there is NO REASON to attend a town hall meeting to get your questions answered, we are answering them below:
Q. Should I file a claim with my homeowners’ insurance or TPC’s hotline?
a. We recommend filing a claim with your homeowners’ insurance carrier. They have a duty to protect your property claims and ensure your repairs are promptly and properly paid. Your homeowner’s insurance will then seek reimbursement from TPC for any payments they make on your behalf.
Q. Am I required to communicate with TPC or their adjusters?
a. We recommend that you NOT talk to TPC or give a recorded statement.
Q. How do I protect my claim or prove my damages?
a. Take extensive photographs and video footage of any and all damaged property— structural or otherwise. Contact a licensed and insured contractor to come out and provide an estimate of your damages. This independent estimate can be used to compare to any estimate provided to you by your homeowner’s insurance carrier or TPC.
Q. Can I get reimbursed for evacuation expenses?
a. It is our understanding that TPC is offering reimbursement for out-of-pocket expenses (room, food, etc.). Feel free to accept whatever monetary amount they offer you for those out of pocket expenses, but DO NOT sign any type of waiver or release of any claims. It is fine to sign an acknowledgement of receipt of the money, but don't sign anything that gives up your rights to any property damage or physical injury claims that you might have. It is best to have an attorney review anything TPC asks you to sign.
Q. What if I sustained bodily injuries?
a. Seek treatment from a medical professional who can properly assess your injuries and provide the appropriate medical care.
Q. What if I inhaled fumes and smoke?
a. Seek treatment from a medical professional who can conduct a blood test and provide the appropriate medical care.
Q. Should I join a class action lawsuit?
a. No. Currently, there is a request for a “class” to be certified. Should this happen, you will be included in the class automatically. If a class is certified, you have the right to opt out of the class and have your damages assessed individually should you choose to go that route.
Q. What if my business lost revenues as a result of this explosion?
a. Some business owners are covered by a policy that provides business interruption insurance. If you have this coverage, contact your agent and file a claim. If you do not have this coverage, you have a claim against TPC, and we would be more than happy to represent you.
It is important to understand that TPC’s adjusters do not work for you, your family, or your neighbors. These adjusters are hired by TPC and/or their insurance carrier, and in turn they are likely going to look out for the company’s best interest. It is up to you to choose to protect your claims how you see fit.
