Just an update on the court system in Tennessee... the supreme court has mandated courts across Tennessee to be closed to in person appearances through May 31, 2020, with some limited exceptions for bond hearings, jail dockets, emergency petitions, and the like.
Here is the language directly from the order:
Under the constitutional, statutory, and inherent authority of the Tennessee Supreme Court, the prior suspension of in-person proceedings, except for jury trials, in all state and local courts in Tennessee, including but not limited to municipal, juvenile, general sessions, trial, and appellate courts, shall be modified as set forth in this order. Unless otherwise noted herein, the provisions of this order shall remain in place through Sunday, May 31, 2020.

Just an update for those of you with concerns in a courtroom at this time. Attached is a copy of the Supreme Court Order issued 3/25/20. To sum it up, the closures/continuances have been continued THRU April 30, 2020. Originally they suspended "in person" appearances thru 3/31/20. But they have extended that now thru April 30, 2020.
What that means to you: If you have a court appearance scheduled for March or April of 2020, then your case has been continued (unless it meets one of the exceptions listed, like bond motions, jail dockets, and emergency petitions, etc). Courts are OPEN...but NOT for "in person" court appearances. All Jury trials, general sessions (civil and criminal), Juvenile court proceedings are closed as it concerns any "in person" appearances...thus continued likely to May or June.
If you have an attorney who has not updated you, you should contact him/her for more information.
If I am your attorney then you have already been notified by text or email of the changes. That said, if you have further questions, don't hesitate to call me direct on my cellphone (which you should already have :).
These are un-chartered waters, so be flexible if you have pressing matters in the courthouse. But if your case is not a "jail case", or an "emergency" then just enjoy the break and embrace the process (as it has likely been continued to at least May, and in some cases longer).
Lots of questions recently about court appearances. Especially from out of state clients. Here is what we know. The Tennessee Supreme Court issued a mandate on Friday limiting all "in person" court appearances in Tennessee (with some specific exceptions). The exceptions are things like orders of protection dockets, plea deals for people in jail, bond motions, and the like. ALL general sessions civil matters have been postponed until April. All Bond dockets, and even Circuit/Criminal Court Jury trials have been limited (unless the jury trial was already in process).
Bottom line: If you have questions about whether or not you are required to appear in court... don't hesitate to call me.

Wow...so, here we go again. For those of you who have not heard yet, the Davidson County General Sessions Court Judges have decided to shut down again, but this time for 90 days!! Beginning Monday December 7th, the Davidson County General Sessions Court will close many criminal bond dockets for 90 days. If you have a pending criminal case (and some civil cases) be sure to check the docket for the changes. It is likely that your case will be continued if it is set within the next 90 days. Today, I got a new court date in one case set for "June 2021". So there's that!
But... on the brite... the tomb is still empty!

Most of you know that the Supreme Court has mandated closures of the courthouse to "in person appearances" in most criminal bond, and civil cases. While there are some exceptions to this, for the most part if you had a court date from January 1 thru March 31, your case has likely been continued.
Stay in touch with your attorney about the new date. And just know... most of the time the clerks do not "ask" (or even notify directly) the attorney of the new date or check if it is a "good date for the client"...but if your date was moved to a date that is not convenient, then it should be easy to change.
This too shall pass...but when it does, there will be a HUGE backlog of cases that have to be adjudicated.
So when we are allowed back into the courthouse for in-person appearances... "pack your patience" (my grand-momma used to say).
Police are criticized alot in this day and age. Many people across the country don't understand the police. Some very publicly criticize the police, and want to even "defund" the police in some cities. But one thing everyone should be able to agree on is that they have a dangerous job. If you get offended by a police officer snapping at you to get your hands out of your pockets, or approaching your car on a traffic stop with his hand resting on his gun... just remember this video.

The Supreme Court Amended their order shutting down Courthouses across Tennessee to allow them to reopen 2 weeks early. So, yesterday 3/15/21, courts were allowed to have in person appearances again. If you had court in late March and "thought" it would be automatically continued, just be aware that it may go forward as scheduled.
