Medical malpractice claims are often brought against hospitals or other institutions, in addition to, or instead of, physicians. Hospitals can be found legally responsible in several different ways: --> The hospital may be found to be vicariously responsible for malpractice by hospital employees, including incompetent physicians. --> Most medical malpractice claims against hospitals in Connecticut are based upon claims that the hospital is legally responsible for malpractice by one of their staff under the legal doctrine of “vicarious responsibility.” --> A hospital can also be held liable for negligent hiring. That is, under certain circumstances, a hospital may be legally responsible for hiring or retaining an incompetent physician, or one who lacks proper credentials. In 2009, Attorney Andrew Groher settled a case for $4.1 million dollars on behalf of a 42-year old man who was rendered a quadriplegic as the result of a high speed police pursuit. On a beautiful spring afternoon, while on his way to pick up one of his children from school, the plaintiff was struck broadside by a car traveling at a high rate of speed. This car was being driven by a 15-year old boy who was being chased by the police at speeds in excess of 70 mph. The chase took place in a densely populated area of the city and was initiated by a school resource officer simply because this young boy failed to stop for his unmarked police car. It’s only natural to want the best. Did you know that in Connecticut, the rules that govern ethical conduct by attorneys restrict attorneys from proclaiming that they are “the best?” The rule makes sense because, otherwise, some attorneys might brag that they are better than all others and potential clients could easily become confused by such claims. So, how do you choose a personal injury lawyer then? We suggest that you spend some time investigating reputations, which are hard-won, often over many years. Ask people whose opinions you respect. Jaywalking… Kind of a strange term – right? So, where did it come from? Research its origins, and you'll quickly find it was a term used in the 19th century to describe someone who lacks sidewalk etiquette. Look a bit harder, and you'll discover that the auto industry in the 1920s seized on the term, promoting it to newspapers across America as a description of reckless pedestrians. Why did the auto trade invest so much in that effort? A medication or medical device can be defective in numerous ways, but product defects generally fall into three categories the first of which is defective design. Defective design is when a product has a defective design, this means it is unreasonably unsafe for normal, typical use, i.e. the risks outweigh the benefits. For example, if an over-the-counter pain medication results in an excessive risk of internal bleeding, it could be said to have a defective design. If a medical device that must be implanted internally has a very high risk of breaking apart once inserted, it could also have a design flaw. If you think you have been injured due to a defective medical device, call us. We're here to help.
