5 strategies for estate planning to get you started protecting your family and funds
VIRTUAL ASSETS SHOULD BE PART OF YOUR ESTATE PLANNING -
Are your digital accounts, including photos and memories, secure if something happens to you? Often people overlook digital assets during their estate planning. Digital assets encompass social media accounts, online media accounts, and cloud storage which typically include photos and important scanned documents.
It is important to consider all of these in your estate plan and provide your executor with the ability to manage these accounts.
Take time to prepare an inventory of your online accounts and passwords. Place a copy of this inventory with your estate planning and other important documents. You might consider a master password keeper (Dashlane or Lastpass) and leave the master password with your estate planning documents such that your executor can easily access these accounts when needed.
Social media accounts continue to be active even after a personโs death. When left unchecked, those accounts can become vulnerable to hackers and even identity theft. Some social media companies allow the user to designate a legacy contact (Facebook, Instagram) โ an individual designated to manage your account after death. Others deactivate accounts after the executor provides proof of death (Twitter, Pinterest). Still others have their own set of rules. Please check with each company to find out what requirements they have.
Online media accounts include streaming services (Netflix, Hulu, Disney+) and gaming services like Xbox do not consider movies, books, and games transferrable upon death. When you purchase online, you are merely purchasing a license to use the move, book, or game rather than owning it.
Online storage accounts are a great way to store photos, genealogical material, and important documents. However, once notified of your death, these accounts are generally shut down and your cherished memories and memorabilia are lost forever. It is important to maintain a hard drive or other storage backup for these items as well.
The Uniform Fiduciary Access to Digital Assets Act of 2014 provides fiduciaries with guidance in managing digital accounts. Consult your Ruberg Law, PLLC to learn how this Act affects your digital assets.
https://www.ruberglaw.com/blog/2020/11/remarrying-in-midlife-avoid-accidently-disinheriting-your-loved-ones/
Today, weโre seeing more and more people getting divorced in middle age and beyond.
In fact, roughly one in four divorces is a โGray Divorce."
Those who get remarried often bring one or more children from previous marriages into the new union, which gives rise to an increasing number of blended families.
Check out our Blog Post where we use three different hypothetical scenarios to discuss how a failure to update your estate plan after a midlife remarriage has the potential to accidentally disinherit your closest family members, as well as deplete your assets down to virtually nothing.
And if you have a blended family or are in the process of merging two families into one, contact us today to discuss all of your options.
Ruberg Law appreciates the sacrifices of the brave men and women in our armed forces, past and present, on this Veteran's Day and every day.
Going through a divorce can be an overwhelming experience that impacts nearly every facet of your life, including estate planning. Yet, with so much to deal with during the divorce process, many people forget to update their plan.
First off, you need to update your estate plan, not only after your divorce is final, but
Hereโs why: until your divorce is final, your marriage is legally in full effect. If you die or become incapacitated while your divorce is ongoing, your soon-to-be ex-spouse could end up with complete control over your life and assets. And thatโs generally not a good idea, nor what you would want.
